    Judge Orders YouTube to Give All User Histories to Viacom

    Google will have to turn over every record of every video watched by YouTube users, including users' names and IP addresses, to Viacom, which is suing Google for allowing clips of its copyright videos to appear on YouTube, a judge ruled Wednesday.

    Viacom wants the data to prove that infringing material is more popular than user-created videos, which could be used to increase Google's liability if it is found guilty of contributory infringement.

                The Electronic Frontier Foundation has already reacted, calling the order a violation of the Video Privacy Protection act that "threatens to expose deeply private information."
                Google correctly argued that ?the data should not be disclosed because of the users? privacy concerns,? citing the VPPA, 18 U.S.C. § 2710. However, the Court dismissed this argument with no analysis, stating ?defendants cite no authority barring them from disclosing such information in civil discovery proceedings, and their privacy concerns are speculative.?

                  but to really deter copyright infringement, shouldn't the scare be put into those that uploaded the videos? If people start getting sued big for "sharing" videos under the whole "user submitted" website model, it could really put a dent in the piracy thing.

                                              I said it before the sale and I said so after the sale

                                              I am going to go so far as to predict that Google shuts Youtube down while it is modified with better copyright filters or Google closes Youtube entirelly which may be to drastic but I definatly see YoutTube going down for a while.

                                                                      Good for Viacom. There needs to be some serious steps in controlling copyright infringement.

                                                                      Get the systems first, get the users second. If there is no system to share under, the users will have to go back to sharing one on one. It's beyond impossible to shut down sharing when it's one seeder and 20 million sharers.

                                                                          What a joke. Google is in the forefront of privacy violations, even worse than facebook. They collect everything about your behavior on line and erase none of it. Emails you delete from your gmail acocunt are not deleted, only their record in your inbox ir removed. Google sets a cookie with unique ID on your machine and everything you do is store in their ever growing database of your on line activities and they are assigned to your unique identifies. Ever wandered why it is you can't use any of google's services when you disable cookies? What a bunch of hypocrites.

                                                                              I'm behind Viacom on this one. They are doing what is needed to bring down illegal Tube sites and P2P. Seems some here support piracy and some hate it and some hate it and love depending on whether they are using it on YouTube or fighting it on Redtube.

                                                                              We should use this decision and sue the buggers illegally uploading porn.

                                                                              As for privacy matters. If you break the law you should not have any rights of privacy. The answer is simple, don't pirate or support them and you will stay private.

                                                                                  There is another side to this that no one has seen yet. Look on the big porn Tube sites and see the people uploading, some are clearly the owners uploading clips for advertising, some are from people doing a couple and a lot are from people who seem to have nothing better to do than upload hour after hour. Maybe an auto uploader or maybe the owner of the site ripping a members area and using it as uploaded.

                                                                                  To claim it was an independent surfer the owner of the Tube site has to able and ready to prove it was a surfer. Then the copyright holder can sue the uploader. I'm cynical and don't see members up loading hours after hours of porn.

                                                                                    Mark Cuban actually just wrote about this on his blog. Basically he says what Viacom is looking for is proof that Youtube controls the content of their site on their end. they may use porn as this proof. Right now Youtube claims the site is policed by its users. If they find out through these records that Youtube has controlled content by killing porn videos before they even hit then this could cause Youtube to lose its DMCA and they would be fucked.

                                                                                      If your information is on the database and you were violating copyright laws your right of privacy ended right there. Ended by you making the decision to break the law. Privacy laws were never meant to protect criminals. Yes the records contain people who were not viewing or sharing copyright material and these will be ignored. So if you were uploading content you own then you have nothing to worry about.

                                                                                      Must do a search and see what you think of porn Tube sites and the people who upload to them.

                                                                                            That's pretty stupid, a user has no way of knowing who uploaded the content or if the clips are legit or not, for all they know the clips were uploaded by legit copyright holders... .maybe on stolen-copyrighted-videos.com something like that will stick, but certainly not on a mainstream site like youtube...

They need these records to find out whose guilty and whose innocent. But it's good to know you want to make catching and stopping copyright infringer's as hard as possible.
