First off any webmaster who isn't watermarking their videos in this day and age is just plain idiotic. I can't count the number of videos/content I've seen on tube sites that I know would convert with my traffic but for the life of me I can't find the originating porn site, let alone the affiliate program to sign up with. Imagine what the affiliate is losing in potential sales.
Second, I don't know of any friend under the age of 25 that if they are looking for whole films / dvds / members areas that doesn't torrent rather than tube. Face it, even if you download the .fla files the quality is shit and if you want to convert to divx or even a shitty mpg it's impossible to up-sample.
Third, take my brother as an example. He is gay and loves the user submitted true amateur uploaded content - no studio's involved. He also has joined a slew of gay dating sites he has seen advertised on the tube sites after he has been "warmed up".
I know these aren't answers - but that's my point. If I had a good one I would be rich ;) What I'm saying is that the old model of sue and protect isn't viable anymore (if it ever was). It's the internet and "information wants to be free." The question is this day and age is how to harness the clear preference of the surfer and capitalize on it rather than fight it - it's a war you won't win. If the RIAA can't then do you really think you can?
Think iTunes and VOD as an simple example. There are porn stars I love and I really don't want to pay $29.95 just to download the one scene from a site - similar to why iTunes is popular - I can get the single without having to pay for the whole album. They key is I'm willing to pay. It might not be the full membership but then again I'm getting what I want and the paysite is getting a nice piece of coin in exchange for a tiny amount of bandwidth cost - in volume this adds up.
The answers are out there, and I wish I had them - but I do know this, the current model is broken and whoever cracks this nut will be very wealthy indeed.
