You can't take 10 seconds clips of any artists' music and put in your porn trailers.

If you owned a music review site yes you could get by with it, but not a porn site. (doh)

songs in the jukebox at the bar... the bartender owns and collects all the cash out the jukebox, should the copyright holder of the song not get a royalty? it was commercially sold...... Where's the lawsuits?

SOMENAMEtube.com runs contests for others to lipsync entire commercial songs in videos on their website which is a commercial enterprise...Tthe people who made it might not be commercial... but should not the song owner get royalties from the tubesite? Why is this tubesite not getting a visit from the LOCAL SHERIFF?

The rules regarding a TV news station having a snippet of music in the background as part of news coverage is vastly different than someone using the music to promote their commercial enterprise without having a license or paying royalties.

Put another way, the news station can not use 10 seconds of a copyrighted song as their nightly lead in.

Yes, there are tons of royalty free music sites to purchase music these days. A lot of it s pretty good too.

A few years ago there were not as many. It's a very rapidly expanding market these days.

The label in question is very cool and the publishing company doesn't really give a shit as long as the songwriters don't. A full fledged lawsuit isn't likely. It's not like she's being bukkake'd by 7 black guys while wearing a ball gag.

Isn't most of Daft Punk's music based on samples of other songs anyway? :)

Yeah, they do use a lot of samples. But, they have absolutely cleared and paid for everything they use.

I'm not sure the song in question, "Around The World" has any samples though.

No matter, licensing a song for web use is much easier than most people here imagine. Even if it's for a site like BrookeMarks.com. Anything more hardcore isn't as easy unless you have relationships with the artist/label.
