Hi all! I just wanted to ask your opinions on the following matter.
Recently I registered the domain name: SMUTDESIGNS.COM. I have been working on brining it up for a few days now.

So, I was surfing around today, and went to Netpond to check out their designer's section and to find the "add-url" page to bookmark for when SmutDesigns.com is ready to go live.

So, while I was there, I noticed that the page I want to get listed on has a "SMUTDESIGN.COM" there. I checked the site out, and it seems that they also provide adult site designs.

What do you think... Could a legal battle come out of this, if I get listed there? I know that if I own the trademark on Smutdesigns, then nothing can be said about it, but, SmutDesign and SmutDesigns are very similar, and offer similar services. I also know that unless we are in the same state, there's not much the other designer can do about it. But, I don't really want to step on anyone's toes.... ya know?

I'm just wanting to get some advice on this, and maybe to find out what you either know about the law pertaining to this, or what your opinions on the matter are. If you've had something similar happen, please explain.

1st off- if the plural was that important to them then they would have registered it. right? right.

2nd- look thru the phone book say under plumbing maybe...u may have (A Plumbing) then (AA Plumbing) (AAA Plumbing) and so on. im not a lawyer but id say since your selling a service and the name of your company is more of a description of the service rather than an original name your prolly ok there. its not like you registered the name PEPSI.

3rd- since you are selling a service and in this case it is a design service and each designer is original in his own right then that would make your designs different from his and thus result in your own unique site and/or business. so no i dont see how you guys have the same deal going on.

4th- maybe you'll get some bonus type in traffic from his advertising and or references if thats the case then he shoulda thought of that and refer to (1st off)

Yes it is! I've got a few good ones not doing anything... Sort of squatting on them... I was considering "leasing" them out, but, I may want to use them at some point. LOL

Yeah, I think I'll just go ahead and put it up. Maybe I'll trademark SmutDesign and SmutDesigns... and make the other guy give up his domain. LOL. Just kiddin'.
