You must figure this out for yourself. Of course on every check they send you is a TOS statement stating that you agree to the current terms of service when you endorse it. So I guess it can be said it is your fault that if you cash a check before going in and reading the TOS it is your fault. Though I doubt that if you disagree with it that they would still send you checks until you signed one agreeing to it. If any company deserves a trophy for creative ways to screw affiliates and talent it should go to webpower.
