Thumbnail TGPs: Legal Content Question

Hey guys,

Sites like Teeniefiles / SexOcean / RawPussy / etc. have a lot of thumbs on their sites. They link to galleries and other sites. Isn't this illegal? They don't have the licence for the thumbs.

Can't they get in big trouble for doing this?

Ok, same question for the content providers/owners:

What do you do when you see one of your pics on one of those Thumbnail TGPs?
They do link to a gallery (gallery owner has a licence) but the TGP who has the pic on his site, does not have a licence for the pic.
Do you (content providers/owners) think the TGP is doing something illegal?

I remember reading something about the government passed a bill (or whatever its called, hell if i know) that states using thumbnails of an original image is not a copyright violation.

Correct me if im wrong

That is an interesting question that you raise...

From my understanding of most content usage agreements, it's kind of a look the other way situation. Where most affiliate programs would ignore the infraction, but it is an infraction. However, the first problem any of these sites will have could be a big one, because the affiliate programs aren't going to bitch as long as they are making sales AND ok with the owner. If at any point that TGP owner falls into bad graces with a sponser, watch out because the sponser can probably win in court.

So, in my opinion, content owners will probably let it slide, until they want something, or don't like the owner.

it all depends on the licence. If you have a set of photos that allows you to make banner ads and such with the photos the thumbs on sites like that would be legal as they would be advertising. Most content has this provision for advertising, but not all. So it's best to read you contract cause if you submit a thumb and don;t have the right to use that thumb for advertising then you could be in copywrite infringement.
