Anyone have connections in Chicago for a good lawyer? Friend got DUI

Well, it's a bogus DUI but nonetheless, they have to take care of it and can't afford their license suspended.

anyone have connections to a good attorney there?

basically they can do what they want in this town.

same thing happened to me years ago in California. charged me with things, threw me in a cell and then later dropped all the charges. that was lovely.

Well, I can't speak for IL law, but contrary to popular belief, in CA they don't have to show you the radar.

As far as arresting someone for DUI with no testing, it sounds like there is a piece of the puzzle missing.

I know they can bust your ass if you refuse to take the test.
I also know not all states are required to show you the radar.

As for how the person got the DUI when they were not driving is well umm interesting. Unless that city had a borrow a English cop for a day program and the officer got confused.

By the way with most DUI convictions, they often will allow to and from work waivers. So rarely is anyone that fucked, unless of course they are a driver of sorts.

That is so incorrect it isn't even funny. Even judges have it wrong.

actually per my research and knowing others who got a 'permit' it is actually correct:


WHAT IS A STATUTORY SUMMARY SUSPENSION?

A Statutory Summary Suspension is an automatic
suspension that the Secretary of State places on your
driver's license because you either refused a blood,
breath or urine test; or you took such a test and it
revealed a blood alcohol concentration of 0.08 or
greater; or it revealed illegal drugs in your system.

This suspension will go into effect on the 46th day
after you were arrested.

If you have not had a DUI suspension, supervision, or
conviction within the last 5 years, you will be
classified as a "first offender" for suspension
purposes. (This does not mean that you are a "first
offender" for DUI sentencing purposes.)

A first offender will be suspended for:

* 90 days if you failed a blood, breath or urine
test;
* six months if you refused to take a blood,
breath or urine test.

If you are a "first offender" then you are eligible
for a Judicial Driving Permit for work, school or
medical purposes.

If you are not a "first offender" then you will be
suspended for:

* one year if you failed a blood, breath or urine
test;
* three years if you refused to take a blood,
breath or urine test.

Regardless of your eligibility for a driving permit,
your summary suspension can be challenged by filing a
"Petition to Rescind the Statutory Summary Suspension"
with the Court. The grounds on which the suspension
may be challenged are limited by statute (See, 625
ILCS 5/2-118.1).

So he wasn't speeding and wasn't drinking and still got pulled over and arrested for DUI?

I hate that shit, it always happens. Getting arrested for something you aren't doing.

Nevermind adult broker posted it.

Fiance at the time got one (her first and only). Was perfectly allowed to drive to and from work and to doctors etc. She even got pulled over once and it was not an issue.

they were driving and did get pulled over for 'speeding' . no radar shown and booked on dui though no tests to prove DUI. he did not resist taking a test either.

anyway, I got a referral from BJ in this thread and BJ rocks!

regardless of the details, he needs a damn good lawyer regardless of symantics or splitting hairs. for all I care he could have been driving with his feet on the steering wheel and eating a whopper at the same time. Need a good lawyer nontheless.
