if someone states 1:30 or 1:50 conversions

and i convert 1:800
can i sue them for false advertising?

Can you file a lawsuit? Sure. Would you win? Probably not. Too many variables (your traffic, etc.).

Would your lawyer win? Now that's another question ...

What would you sue for??

If their product is not what they advertise, perhaps you could sue for lost income as a result of fraudulent advertisement, but it's a long shot.

Why don't you try to settle it with them, ask about the situation, see what is actually happened, provide evidence of your 1:800 conversion rate, and all before threatening legal action?

its a hypothetical question
since i am seeing more companies claim these conversion rates
in their banner advertising and there are truth in advertising laws.

So i was wondering if i signed up..
promoted them..
and didnt get their advertised conversion ratios
if they are held liable for these claims

That's their OVERALL conversion rate...not each individual webmaster.

The FTC pays closest attention to:


ads that make claims that consumers would have trouble evaluating for themselves, such as:

Yes you can sue and it is a some what unique idea. If you are serious, with some effort, you may find an attorney that would take it on contingency. If he can verify that the company you choose to sue, has enough coin to make it worth his time, and expense. There are precedents for winning cases for false advertisment. It would do this industry some good to eliminate some of the BS that is spread by some people in this industry.

It is not misleading - anymore than lawyers who say "we have collected millions for our clients".

program xyz converts at 1:100 is a TRUE statement - as long as that is the ratios THEY are getting.

but of course you can sue - as someone pointed out - you can sue anyone for anything. I could sue the president of the united states for not giving me a red rose every morning.

And hey - with lensman as your witness - who knows - you could win millions.

I am not the one considering a lawsuit, but I may discuss the matter with my attorney and see if the idea has any merit at all.

When a sponsor claims anything lower then 1:300 they are not talking about TGP traffic.
Sure a site can convert at 1:20 with SE traffic but not with TGP traffic.
I sent a lil tgp traffic to a site where they claimed to do 1:60 to 1:150 or so with tgp traffic...... so far doing 1:950 with their pre-build gallery and that 1 sale was a trial.
