No it doesn't genius. The content was already uploaded to another source, and he posted links to it on his board. The most these idiots can do is waste money and try and tie him up in court, but the fact tht he is in Amsterdam means they can only bend over, spread their cheeks, and take it in the ass. Please don't assume you have a fucking clue how this works until you have been through one of these cases, which i recently have. You are talking out your ass and speculating. He can simply ignore whatever legal action is taken and go on with his life.

DMCA only applies to where the content is hosted and it is not on his server. Good luck getting the megarotics of the world to listen to you wannabe lawyers.

He embeds the videos... BIG difference. It does not matter where it is hosted, its ON his site, and its SELECTED by him, he can not claim that its user submitted content, thus he is not protected.

And on top of that, the least he needs is 2257 docs...

Although we will have to see what the DOJ says to some comments before we are sure of that I guess...

Ahh, Amsterdam, didn't see that, how do you know? 2257 of course does not apply then... the rest is still a problem, even in the Netherlands.

If you honestly believe that then all I can say is feel free to sue and see where that gets you. I am talking from experience when i say if it is not on his server then you have nothing, especially because he is not in the US. If you had anything the millions of sites that do the same thing would be taken down, and you would all be living fat off of the damages.

If this is the case, would make for a big loophole in the law... I can hardly beleive it though...

I wonder if they think the same way for 2257, which I highly doubt though...

But as I said, I doubt they really think this way for DCMA either...

I know I'm coming off as an asshole here, but the sponsors that didn't give the first shit about their affiliates interests are now seeing what happens when those affiliates decide to strike back. Thats why the biggest torrentsites are blocking dutch trafic. They are getting closed down also. But u can not stop it now. The only way to stop it is in your own hands dont pay them. If they cant pay their bills they will stop.

And make a club that searches for this and tries to block them. Most of the times a good email or letter wil be sufficient.

What i don't get is there not somebody at the sponsers checking if the page is good for them. When he submitted somebody had to watch the site right ?

They know exactly where the traffic is coming from, and it is a no lose situation for them. The can profit off of it until they are called out on it, then they can feign ignorance and seize the affiliates money and be lauded as heroes when they do.
