51 spammers

Mutt 09-26-2007 12:09 PM

he's a smart guy and always posted his libertarian views - might even find some of them on GFY - but he lives in American and broke its laws. case closed. the punishment seems excessive i agree.

i know a lot of people should be thanking their lucky stars it was him and not them because they spammed as much as Diamond Jim. Jim just happened to be the one who got caught and is going to be made an example of.

Maybe so, but even "good friends" and "great guys" take part in illegal activities sometimes.

He put his neck on the line to make more money. The reward was worth the risk to him. So he isn't an innocent victim we should all feel sorry for. This is a calculated risk by anyone who does it.

MOST of us work within the law and make honest income online. This man did not. You can't spin this any other way.

ztik 09-26-2007 12:51 PM

Pay your taxes. He could be doing 5 years instaid of 20 years.

Thats what they always bust these spammers with. They think "going offshore" will protect them. Time after time again I see people get busted for money laundering. I bet they could have got off with a fuckin fine if they would have kept clean books

The Other Steve 09-26-2007 12:55 PM

Maybe some of you guys haven't noticed what one of the charges was that they were found guilty on.

I'd really like to know what the legal interpretation of 'transportation of obscene goods' really is because that could have implications for all of us.

RawAlex 09-26-2007 01:12 PM

The Other Steve: Some of the sites being promoted included "Fisting Action". I think that one or more images sent with the emails to promote that site might have done it.

Shok: I was totally surprised when I first saw this a couple of years back a realized who it was. He wasn't exactly who I expected to see behind a spamming operation.

As for the sentence, so far I have found no information as to how many years (if any) was the punishment. The high end is about 50 years, but certainly doubtful, but the money laundering deal is a 20 year that normally wouldn't get watered down much under 7 or 8 unless they are really lucky. We shall see. Anyone have any news?

Guilty of violations of Can-SPAM, transportation of obscene materials, and money laundering.

The money Laundering by itself is up to 20 years. The Can Spams are 5 years each. THe obscenity I am not sure of. 8 counts total, the real "up to" could be 50 years or more done consecutively, which I am sure isn't what happened.

I am surprised there isn't a whole big stink about this. After all, the "transportation of obscene material" is a really big deal, essentially showing that moving this material over the net is apparently a crime.

I would think that some of the others on trial for obscenity charges are likely NOT happy to have seen this conviction.

I'll agree with you and the "transportation of obscene material" was the first thing that threw up a major big red flag. That is a pretty scary judgment that was just put on the books, when you stop and thing about it.

Now the name Diamond Jim rings a bell, but I'm still not sure who these guys are. Maybe they were nice and top notch guys, but the deal is they were still spammers.

When I was new and dumb to this industry, I looked into spamming. I heard about these guys making shit loads of money sending e-mails. I almost did it myself, but that was before I figured out how these guys mail.

Everyone of these spammers mails by proxie. That means they are supporting the ass fucks that use exploits and trojan people's PC's. So they may have been the nicest, coolest guys on a board or at a party, but they were still supporting the very thing everyone here hates.

Spammers depend on trojaned PC's to send their mails, so if you are a spammer or support spammers. Well then you are supporting exploiting and doing illegal installs on surfers PC's and that means you are part of the problem that's killing this industry. It's not just about annoying e-mails in your inbox.

I'm guessing you haven't been in this business too long and don't know who's who around here, and who does what. Based on this case, I'd say you need to find out.

Brad 09-26-2007 01:25 PM

People amaze me. So what, these guys were spamming. Is that such a big deal? Like I always say in these threads, I'd much rather them focus on the spam the ends up in my real mailbox at my house. On a computer we have software and a delete button to deal with it, in real life (you know the life that exists beyond the interweb) you have to throw the spam out and it fills our landfills for our future generations to deal with.

Someone said it earlier in another thread...we are all here (with the exception of some surfers here) to make money online. It makes me laugh that there is such a double standard. People will probably say: "well it's against the law here, spam laws..." and whatever bullshit rhetoric they can think of. But the bottom line is that we all are trying to make money. I personally don't spam and I don't really like receiving it anymore than any of you, but guess what...I hate those banners with sound and those ads that pop up over yahoo and other sites these days. I hate pop ups and pop unders and I hate the ads at the beginning of online videos and a bunch of other techniques that everyone here employs to make money.

These guys were just trying to make money just like us. Spam is not going anywhere just like file sharing it is going to be a thorn in our sides that we need to adapt to and learn to work around. Besides, most of the spam is not originating from North America anyways.

Oh and the sentencing is ridiculous for such a small offence considering the real players in this world can steal money from investors (Conrad Black) or send people off to die for oil (Bush Jr and Sr.) and get either a slap on the wrist or a pat on the back.

Anyways, that's enough for now. Let's stop the mail spam though...if we wanted to know what deals are going on at Best Buy or the grocery store we would go on the internet to find out anyways!

Bunch of hypocrites.

Sentencing for the pair was as follows:

Kilbride: 78 months.
Schaffer: 63 months.

Fines, etc won't be done until October, but the gov't is going for over 1.1 million plus the forfeiture of "certain assets".

Papillon 09-26-2007 03:57 PM

Well..... If someone lives in the US and loads up database of emails to a server in a Amsterdam and that server sends out spam email.... Seems to me like the email came from a server in Amsterdam, not in the US.

However, I don't think it matters what country the server was in. They were in the US and they send the email, no matter where the server was located.

These are people that many knew from back in the day.

Granted, you can't break the law, but kickin a guy when your down is another.

I think a big reason why DJ was caught
was he was billing from his own US merchant account, it was easy to trace it back to him.

Am I correct?

6 years in the slammer, no joke, hope things work out..

Quick Buck 09-26-2007 07:39 PM

if you broke the law then a judgement is fair... i just think the punishment doesnt fit the crime.

rapists and burglars get less time... people who commit assault get less time.. drug dealers get less time.

the good news is that they will likely do all their time in a white collar federal prison if they havent already appealed.

crazy.. i wouldnt wish this situation on anybody.

CheneyRumsfeld 09-26-2007 07:50 PM

don't worry about it, the feds are stupid, they will never catch you.

I think the court was pretty angry about Minors recieving email's.

Just a thought, but when something like that comes into play int he court room it's pretty much curtains for the defendant unable to prove otherwise maintaining an non adult verified list.

Thing is they could have adult verified the lists as I understand they were impeccable at targeting niches with precision.

wow that really sucks for them...anyone know how they got caught exactly?
billing on their own us merchant?

Shey 09-27-2007 01:50 AM

Well, last time I came home to the US from a few months in the Philippines, I got ass raped at customs and was accused of being a spammer because I told them I advertised adult sites (after they made me boot my laptop). I would have probably answered different to this thread before that happened but now...Fuck'em, they give us all a bad name. :321GFY

There are certain boundaries that decent webmasters do not cross. Some are laws, others are industry standards.

You sound like guys who use creative redirection methods when submitting TGP galleries. When they finally get busted for just trying to make money, it's "bullshit rhetoric" as you call it and time for a new identity and proxy.

And don't even try and say that mailing doesn't harm other webmasters. I have a very strong feeling that porn spam is the primary catalyst for a wide range of problems brought upon this industry by governments and anti-porn groups.

If you want to make an illegal financial leapfrog over honest webmasters who operate within the law, then don't expect sympathy when you get busted.

Matt 26z 09-27-2007 02:04 AM

Exactly! You can kill, you can deal drugs, child porn, spam whatever.... but if you're caught avoiding your taxes you're fucked - because they will come after you with everything they've got.
