Madrox. You should pay him the money back. That is the problem with quoting a whole job instead of an hourly rate. If the job is not delivered then the client gets the money back unless you guys spelled it out differently.

I understand the feelings that go on when the tempers get going but nothing that has been said justifies keeping money that was not rightfully earned. (No, even his threatening you does not justify ripping him off)

In fairness... no judge will even listen to your "defense" (about the client bitching) - that is totally irrelevant. All that matters is money was paid ($350) and you "apparently" agreed to deliver a product. Again, in fairness, life can have hiccups and the delivery time may be delayed - but that still has not happened and the client is now whining.

The client is possibly an ass, but you are responding no better and no doubts whatsoever, a court will rule against you - and possibly award damages.

For $350 it's hardly worth the time spent talking about it.

Well had a contract been used here, there would have been no question as to delivery date, the problem wouldn't have gotten this far.

He brought this to the boards over a month ago and you promised to pay him back, you should have sent the money by the next day. There is no "I'm short on funds can't pay you now... blah, blah blah" Pull out your credit card and fund paypal and pay him, you don't have a cc, then borrow the money. You had already kept his money for weeks before that point.

You said you didn't have internet access for two weeks after the agreement was made. Then walk your ass to the library and inform him of your situation and offer him a refund at that point. Bottom line, you owe him $350. Work some extra hours at your telemarketing job or put in some extra hours cookin burgers at your dads sportsbar, whatever you have to do to get him his money.
