I am against caps and the primary reason is: Doctors have to screw up pretty badly to lose a malpractice suit in court and unless they lose there is of course no high jury award.

All of you have seen stories in the news about amputating the wrong extremity, testicles, removing the wrong kidney etc.

I recall some twenty or thirty years ago when the nurses in L.A. went out on strike. As I recall the strike lasted several months and only emergency surgery was performed during this period, and elective surgery was not. During this time the death rate in L.A. dropped by more than a significant amount.

I took notice and will not have elective surgery done. Surgeons are dangerous to your health. When they screw up I think high jury awards are justified.

As for the insurance companies, they don't actually lose money, because they are allowed to drain off a significant portion of their money intake to subsidiaries, and are only required to keep X percentage available for claims.

The Republicans are always yammering about caps on one thing or another when it comes to law suits, and a rather large number of the Democrats do the same.

Insurance companies have big time lobbyists as well as being big time contributors to campaigns.

This is nothing more than Bush paying back more of his campaign donors. The guy is unstoppable when it comes to backing certain business special interests. Amazing that he just keeps on in the same direction no matter what the American people want.
