Anyone know the lagalities on this?
How legal is it to use someones image or likeness on XXX animated models? Like celebs for example.
I know celeb sites run shit about celebs constantly and don't get in trouble for it. |

Some free legal advice on this for anyone who needs it. My friends Uncle is an attorney. Here is what he said.
The laws you risk violating are called publicity laws. The right to publicity is a person's right to control commercial use of his or her name and likeness. These are state laws (no federal law on this), so the rules vary widely from state to state. Some states have statutes and others protect the right to publicity through caselaw. Some state publicity laws go so far as to protect against commercial use of a person's mannerisms, gestures, voice, etc. Here's a link on publicity laws, state by state: http://www.ncsl.org/programs/lis/pri...ublicity04.htm Probably the worst case scenario is that you'd get a cease and desist letter and would then have to decide what to do. Since it is pornographic, IF (and that's a big IF) someone finds out and sends you a cease and desist, I'd think they would be pretty inclined to stop your use. |
