A former prison employee accused of having sex with an inmate at the Toledo Correctional Institution was indicted yesterday by a Lucas County grand jury.

Cheryl Malay, who resigned last month from the state prison in North Toledo, was indicted on one count each of felony sexual battery and dereliction of duty, a second-degree misdemeanor.

The charges stem from an investigation by the Ohio Highway Patrol into an incident recorded on a security camera in the prison, the patrol's Lt. Tony Bradshaw said. "The video camera was installed by the prison. A corrections officer who reviewed the videotape indicated there might be some criminal behavior, and that is when he notified us,'' he said.

Ms. Malay resigned from her job as food service coordinator on Dec 14, a day after she allegedly engaged in inappropriate behavior with a 25-year-old inmate. Her husband, John Malay, Jr., a maintenance supervisor at the Toledo prison, committed suicide five days later at the couple's home in Oregon. Mr. Malay, 47, was a 20-year employee with the state prison system.

Meredith Rinna, an assistant to the warden at the Toledo prison, said Mr. Malay had been scheduled to work, but he called in sick on the days leading up to the suicide.

The inmate has about seven years of an 11-year sentence remaining on convictions in Hardin County on aggravated robbery, escape, and burglary. He was taken from the Toledo prison on Dec. 19 and transferred to the Mansfield Correctional Institution.

An employee in the prison system for three years, Ms. Malay was paid $33,446 a year. According to court records, she has relocated to New London, Ohio.
