My take: If this was the first time that X17 had contacted perezhilton to stop, I would say they are being a bit agressive and would likely lose. But they have repeatedly ask him to stop, going as far as to put in a "right mouse" blocker to stop the most obvious method for copying an image.
That this dunderhead continued to use images, and continued to use new images after repeated warnings makes him an idiot, and he should pay every cent of it.
