Has a site ever been shut down for not having a warning page?

Just thinking of taking my warning pages down. Never heard of a site being shut down for not having one.

But I think the theory is that it could stop you from being convicted by a jury, if you were prosectuted. Obviously there must be lawyers saying that they are a good idea or most of the big guys wouldn't be using them.

I look at it this way. If and when the government goes on it's long awaited crackdown of porn sites, I figure that people who don't even have a good faith attempt at warning people about what's inside their site will be easy targets.

Legally, the warning page does nothing, that's true. But if the govt has a choice between two hardcore sites, one has a warning page and one just hits you with hardcore pics or vids right off the bat, I would think the second one would be the one the govt goes after.

Just my opinion. Nothing to really base this on. Just a hunch I guess.

FATPad has a good point, taking the warning down might marginally increase the chances of an obscenity prosecution. But, what are the chances to begin with? How many HC sites are there now with no warning pages?

In my niche, with my content (relatively tame), I'm comfortable with no warning page. I have had no problems because of it and its reflected positively on my conversions. You have to make an intelligent choice about the risk level you are willing to accept, and there are alot of factors that need to be considered here. Where you live would be primary for me, as that is the place you are most likely to be nailed for obscenity in if such a thing ever occours.

I agree with Fatpad on this. There's no legal precedent that we can go by. But do you really want your site to be the one they use to set an example? Like when you're going 80 on the fwy, as long as there's someone passing you at 90 you're okay

Besides the use of a disclaimer, use it for other opportunities...

It's good to use as a splash page so slow connections at least get to your site fast. Send that non-adult exit traffic to a regular sponsor instead of yahoo/disney. You can also preload some graphics for your main page.
