OK.. Some good background data posted so far.... but..

who is Paymonde? Assuming this is the name on contracts Cohen et al (or whoever) entered into with webmasters as clients.

Following on from that... what is Paymonde? Is it a corporation, and, if so, what jurisdiction does it fall under and what is the correct company name? (If it is a corp, it's going to be an LLC, S.A. Corporation, Limited or whatever)

Will not say here since it's obvious this board is being read by the "other side", but briefly, - the actual corp (or trading style) webmasters contracted under, needs to be served paperwork- but first, it needs to be identified and the legal venue known. The sooner this paperwork is served, the better.

Hope to have more feedback from others shortly - but, bottom line - this needs legal involvement and it may be better if a few webmaster claims are dealt with by one legal representative.

Domicile means where is lives. By law, I beleive admistrators must give the main home, not secondary home, where they live.

Since they do not answer their phone, or e-mails, I do not have the "official" answer. But I can tell you the circumstances prior to it. It goes like this..

Sign up with Paymonde. Wait 4-5 weeks for my first fucking payment. Which they miss their first payment. I have to call them since they do not return e-mails, and they release the funds 2 days later. They provide me the 2nd week at the same time. Nice gesture.

Third payment comes as it should, no call needed.

Rumblings on GFY about people not getting paid. Concerns grow since some had not been paid a few weeks prior. They lose the ability to process MasterCard. No information provided for a few days.

Next pay period, they miss my payment. I submit trouble tickets. Call them. No answer. Voicemail. I send e-mail. None is returned.

By the 2nd day, I cancel all rebills in the control panel. Add Verotel to my cascade (along with existing CCBill which I had added same time as NO-PAYmonde).

I send an e-mail to all members of the 4 sites billing with them to notify them I am removing Paymonde from the cascade, and they will have access for November. After that, script will be removed. They will need to sign up here (links provided). Also advise them ANY Paymonde charges after 11/06 should be CHARGED BACK and advise them of the process. That afternoone, locked out of account.

Continue calling, and sending e-mails. None returned. No payments rendered. They now owe me 2 weeks of back payments. Plus I still have 2-3 more weeks that are owed.

MONTREAL ? Third-party payment processor Paymonde has officially gone out of business, CEO Howard Cohen told XBIZ. The company?s demise came after its bank in the Philippines lost acquiring rights to process Mastercard transactions.

?We weren?t left with much of a choice but to go out of business,? Cohen said. ?We have not received payment from the bank, and until we do so, I cannot pay what is owed out of my own pocket. I?m fed up with being beaten up on the webmaster boards. We?re trying to do our best in what is a shitty situation for everyone involved.?

The bank owes Paymonde three weeks of payments and had promised him a settlement Friday, but has still not made good, Cohen said. Cohen could not offer a timetable for webmasters to hear about money owed.

?I want to let everyone know I?m not running away,? Cohen said. ?I?d like to thank all the webmasters that did business with us over five years for their trust and support. I feel terrible for all involved. I?m not a crook. Paymonde is not iBill.?

Cohen promised to evaluate each one of Paymonde?s merchant accounts ?on their own merits.? He said the company is planning to contact every webmaster that is owed money about their financial status, including the amount they are owed.

?What I hate about this whole situation is people on the boards calling me a thief and a scumbag,? Cohen said. ?We tried to take care of all of our clients. I know many of them personally. We were at the shows. We never hid from anybody. We charged lesser percentage [per transaction] than others. And also, everyone should know the big guys like Paycom or CCBill are not immune to this. If their processing gets pulled, how can they pay??

While the Paymonde website is down, Cohen said the company will allow clients into their backend to check on their financial status if they contact him by email.

MONTREAL - It?s official. Following weeks of rumors and speculative posts on webmaster forums, third-party payment processing company Paymonde has gone out of business.

According to the company?s chief executive office, Howard Cohen, the decision to shut the company down came after its bank in the Philippines lost acquiring rights to process MasterCard transactions. ?We didn?t want to shop around and just place merchants anywhere,? Cohen told AVNOnline.com. ?We wanted to have something stable, so we just decided to shut down.?

Cohen said that the bank owes Paymonde three weeks of payments. Although a settlement was promised for last Friday, the bank did not follow through.

?It kills us to [close down],? said the audibly shaken Cohen. ?We had so many big plans and such positive momentum.?

Cohen stressed that the choice to shut the company down was made to spare webmasters any further detriment. ?I didn?t have to pull the plug. We still had Visa; we could have continued processing, but I didn?t see the payments coming in [from the bank], and I didn?t want to owe the webmasters more money. We weren?t going to keep processing them not knowing if we were going to get the money, so I just said, ?That?s it, guys. We?re done.??

Although an official statement by the company had yet to be made, Cohen said he had placed an announcement on the site?s back-end and personally contacted several clients to let them know the news. At press time, the site was inactive. ?I feel [terrible] about it,? he bemoaned. ?We worked hard. We were always out there on the forefront, and we really cared about our webmasters. It?s unfortunate what happened. That?s it. Five years in the business, and that?s it.?

Cohen said he was particularly disheartened by recent posts made on webmaster boards. ?Everybody went ballistic, saying we stole their money. They were saying it before their payouts were even late. To see what?s going on on the boards?seeing people threaten us and say that we ran away with their money?it hurts me. It?s not the case.?

Cohen told AVNOnline.com that he sees Paymonde?s implosion as a cautionary tale. ?We got into a bad predicament. It could happen to CCBill; it could happen to Epoch. Those guys are not protected. Their banks could say, ?That?s it.? No one is safe.?

Although Cohen could not offer a timetable for webmasters to receive money owed, he promised he would do his best to reimburse them on a case-by-case basis. ?We?re good businessmen,? he said. ?We?ll take care of everybody as we can.?
