Why wouldnt they? All policies are required to provided minimal liability coverage, and PD liability is exactly for this type of situation. Unless he was in the process of committing a felony (a common exclusion in most insurance contracts) they should have to pay out. Of course, as you pointed out, this assumes he has insurance.

Something I've never understood.

Just sink them in the ground with a cover on - the fireguys just stick a stanpipe on and they have access to the water. No risk of dumbasses knocking them over.
