To bad we don't have more details, like are they married and is the car in both their names. He'd have to sue her for waste or some sort of tort if she owned the car too. The remedy would be the value to the loss or damage, I'd assume. Prolly varies a bit state to state. Not attorney and so just lay speculation.

Would be way more of an issue in a divorce case. I think that in most states, the court could care less who your fucked when unless there is money involved. What about the kids? If you're married, there your's along with the child support payments.
