				Bush arresting for Bukkake
http://www.thesmokinggun.com/archive/0907061bukk1.html Feds Give "Toilet Man 6" Two Hands Up Bush administration obscenity crackdown nets fetish film kingpin SEPTEMBER 7--In what appears to be a Department of Justice first, federal officials today included the word "bukkake" in a press release announcing the arrest of a Brazilian man for allegedly distributing obscene material. According to federal prosecutors, Danilo Simoes Croce, 42, operated web sites offering "obscene videos for download or delivery in the U.S.. The videos depicted bukkake, fisting, and depictions of defecation, urination, and vomiting in conjunction with sex acts." The Sao Paulo man was arrested yesterday in Florida, where he was charged with conspiracy to distribute obscene material, a felony carrying a maximum penalty of five years in prison and a $150,000 fine. In a revoltingly detailed criminal complaint, postal inspector Linda Walker provides a shot-by-shot description of some of the films purchased from Croce's sites by undercover investigators, who have been targeting the operation for more than three years. Some of titles carefully reviewed by Inspector Walker were "Toilet Man 6," "Bukkake 3," and "Scat Pleasures," according to the complaint, excerpts of which you'll find below. In the Croce document, Walker also includes a brief "background on fetish-type" films, in case readers (like, say, a square U.S. magistrate judge) were unfamiliar with terms such as "fisting." The Croce case is the latest major prosecution brought as a result of the Bush administration's initiative against hard-core pornography. In a communication last year to the FBI's 56 field offices, the anti-obscenity campaign was described as "one of the top priorities" of Attorney General Alberto Gonzalez and FBI Director Robert Mueller. | Yeah, I guess this is much worse than wars created by the government. Dead bodies, and arms and legs blown off aren't half as bad as these awful videos. Its not my cup of tea, but geez I think "Fear Factor" is sometimes worse than scat films and thats broadcast with sponsors on NBC. Also 5 years in jail is rediculous, the guys from Enron are only getting 10 years.

				 | Haha, it's the "Bush" emphasis that makes it funny. That, and the fact that it looked like "Bush arrested for Bukkake" when I first saw it. I was imagining Condi with a load of splat from the entire Cabinet. |

				 | The really interesting part is this: They arrested a foreigner for operating websites from outside US territory. Guess from now on non-US webmasters better think twice before travelling there. |

This is not a case of a foreign webmaster being obliged to comply with US domestic law when there is no business presence, hosting or residency within the US. If this idiot never operated in the US - there is no grounds for any charges or extradition (would be laughed at - for better or worse).

While the main offense is sending videos via US mail, which is obviously illegal, I think the charges over his websites are the more alerting part. | |

The only reason he could be charged/arrested is because he is living in Florida and under the laws of the US and conducting a business within the US. If it was otherwise, and eg. he did not operate a business, host or live in the US, he is not subject to US domestic law. If he was operating from his home country (Brazil), there are no charges - other than any local laws in eg Brazil. Stuff like this does not fall within any extradition treaties. (Tho CP could, but that's normally handled by whatever local law enforcement - cuts out the crap of extradition.) Oddly, prob the only country that would chase it's citizens (and they do) while living in another country for relatively low grade offenses is the US. There appears to be this concept that a US citizen is subject to the laws of the US and whatever other nation they may be living in - no other country does this. Example.. I'm not living in my home country and there is only one obligation to comply with, namely the laws of the host country. There was never any undertaking to comply with the laws of any other country (other than those imposed by international agreement) - else we'd all be in a jail cell for *something*

				 | borys: Just thinking - see where you are going with this Hell.. if any country don't like the content of the net - they can get off their asses and block whatever content. Webmasters have one law to obey - that is the law applying within their country of residence. If a website is legal within that jurisdiction and not in eg 20 other countries - hell, - let them sort the shit out That's what I'm saying and I'm sticking to it - unless some international agreement says otherwise

Cant remember where I saw the link, but there was a pretty big article about it, their stocks took a pretty big dive. Reason they got arrested is that it is now illegal to accept money from a US person if you have a casino that is not located in USA. This could probably happend to extreme porn too (such as scat, beast, fisting, watersports) might also include anal as that is obscene in some states as far as I know.

Oddly, there has still not been an extradition warrant been issued for Kaplan. There is also another background issue relating specifically to the laws under which the "foreigner", David Carruthers was charged, (This can't apply to the Kaplan family because they are US citizens and bound by US laws and they were trading in the US), where the World Trade Org is going to rule on a judgement already given against the US. This basically means ... around three or so US domestic laws (including the Wire Act) are "illegal" under WTO rulings and the next step is enforcing that ruling by sanctions. (Tho, there will prob be some deal to avoid that). But sure.. least for the moment - any management of casinos are not travelling via the US till this shit is sorted It's more profitable to take that business and forget visiting the place - same with any country who has objections to gaming.

				 | Hehe... And re Kaplan - in the event US law scan this board... It's not worth your while issuing any extradition paperwork - the horse is no longer in the stable
