Lol, APICS aren't renowned for their accuracy - I had a similar email once concerning some pornstar pics on a gallery I made.

The pics were from the sponsor I was promoting on the gallery...

well, regardless if you're in the right or not (though it wouldn't surprise me) - i'll say this. APIC is a fucking joke. one of the most unprofessional 'organisations' around. i have a massive amount of exclusive, copyrighted content - and i'd never consider using thoses fools.

a couple of months ago they were accusing lens of support copyright violators LOL.

anyone know the best way to contact topbucks? phone? email that wouldn't take 3 days to get a answer? The main reason why I posted this here is because I know they come here often.
I don't have to much in topbucks, but damn it I didn't make and submit all the galleries for my health

Here is How we deal with it:

1. What image(s) is the claim regarding, including a url, such as http://www.domain.com/imagename.jpg. If all the images on a page are the same single copyright holder, than a page name is sufficient.

2. Who owns the image(s) for which the claim is made.

3. What is the web page that the image(s) appears on with one of our affiliate codes? Such as http://www.domain.com/pagename.htm

Please repeat the above for each copyright holder, please do not combine claims because we cannot identify which image belongs to which copyright holder.

As you can see we need proof before we Nuke a Account.

Kenny... I just got your email about 5 minutes ago. you can icq me at 120353154 so we can work this out. TopBucks complies with APIC, but we do understand that sometimes the content is correctly licensed and errors can happen. Once we figure this out, I will be happy to reactivate your account.

Thnx

Thats how these types of matters should be dealt with

Instead of trashing someones account, on what one person says,
hell that means if I don't like someone I can get their account trashed with ease

Yea, Allison or any other sponsors working APIC, should take a look at some type of policy, because APIC does make a large number of mistakes...So, requiring proof shouldn't be that big of deal and it would protect those who are trying to make a honest living.

ahh thats not nice.. there are plenty of people that work there.

Mistakes do happen. with every company
Whether its CTC not working,
servers crashing,
somebody not demanding proof the content is licensed before terminating an account.

it can all get worked out

Let me tell you my Topbucks story.

They moved servers or something and the scripts were clashing.
Signups were disappearing others were showing up.

When the problem was fixed.
Topbucks not only paid me for the signups that i had,
they also paid me for the signups that were falsely generated

Most of the time APIC is straight up full of bullshit.

I have never seen such illiterate claims in my life, they attack so many webmasters illegally, I would like to see some actions taken against them.

Its bullshit. and the way companies are afraid of them is even more silly.

Seriously, you guys should watch this shit more, APIC is emailing people regarding pics they have no idea who owns and claiming the pics are not licensed and shit, very sneaky tactics, not to mention, the last few cases I have been told about, have ALL BEEN MADE IN ERROR.

This one being like the 4th now in the past couple months.

Does APIC even check out who owns the pics?

They emailed TOPBUCKS? For what? because they are scavenging for Topbucks affiliate links to report you? Did they not contact your host? Or is it some assdawg making 6 bucks an hour digging through gallery after gallery digging up affiliate links?

Emailing the host could be a better move, anytime someone has beef they email the host, the host issues an email of compliance or cease n desist, but these guys attack you on affiliate links? Unprofessional, and ridiculous to say the least.

APIC if you are reading this, eat a big dick ya pussy. You and your silly org, you dont fight for the artist, or copyrights, you eliminate one right to save another, it doesnt work that way.

Show some fucking backbone, these APIC pussies bully whoever they want, email whoever they want, and everyone simply believes what they say and accept it. Fuck that.

APIC, where were you when someone stole my paysite designs or when someone ripped off 3 of my AVS? or snagged my nice new blinking gifs from a recent gallery and used them on their own?

hmmm thats not worth your time huh? Go dig through galleries you fucking parasite.

APIC is a fucking joke, I wouldnt comply with shit until my attorney looked over their claims, and honestly, I would attack them on all fronts with full force had they or if they ever, interrupt my funds flow. Or traffic in ANY WAY. Let alone contact a sponsor and have my account nuked.

This shit should make everyone who buys content nervous.

You are telling me some guy can buy nice content, use that content (obviously better than the shit sponsors provide you) to promote TOPBUCKS sites, and Topbucks has the nerve to believe APICs word before even contacting the affiliate, who is spending hard earned money to promote their sites? Topbucks you are biting the hand that feeds.

I consider APIC like an asshole with a "No Fur" sign walking in a Leather Outlet store.Out of place, and needs to be put out of their misery.

Fucking losers.

Fuck APIC.

From experience, most times APIC contacts us, the webmaster is using stolen content. APIC can be wrong, but with the system we have here at TopBucks we can easily work it out when they are wrong. We are able to deactivate accounts temporarily without losing any info or sales data for the webmaster.

Our policy here at TopBucks is to deactivate the account, contact the webmaster and ask them to either remove the images or provide license information. Once they do that we do reactivate their accounts.

The support message from kristin to kenny seemed a bit unclear about this policy and may have been due to the fact that kristin is new to TopBucks. I do apologize Kenny if that message seemed a bit harsh. It seems like now (after icq contact) we have worked this all out and everything is okay.

If anyone else has questions please feel free to get in touch

As well you fucking should. Due process and innocent until proven guilty yada yada yada. Yes, I know this isn't court but really sponsors shouldn't be so quick to throw their webmasters under a bus on the say-so of some pompous self-serving asshole.

I remember how you guys dealt with this thing a few months ago. TopBucks and others could learn a thing or two.

I don't think our policy is harsh at all. We give webmasters the opportunity to work this out and again it is a temporary deactivation which is easily undone on our end when the webmaster makes an effort to work this out with us and/or APIC

Allison, just a thought here.... why not work it out with the webmaster <i>FIRST</i> and THEN deactivate if the webmaster is <u>proven</u> to be in error? (Like Lensman does)

Again, just a thought.

What is the origin of APIC?

Somebody obviously got pissed off enough and got ripped off several times, and felt the need to start something like this.

I'm not saying its a bad thing, but just as MADD was started, I am sure APIC has a reason for its being.

Who is behind APIC???

What we need is some motherfucking cyber bounty hunters to get rid of worthless, theiving webmasters.

~~oh wait~~ now I see~~

Membership dues? They want membership dues to join their association? Is this a UNION?

Yet another brilliant marketing ploy.

So, if APIC writes you an email, you then place the burden on YOUR webmasters to prove they are not thieves? What a nice Stalinesque policy. Its actually pretty disturbing.

It's all rather hazy, but there is a guy that heads up APIC, but I forget his name at the moment. They have their roots centered in the whole Alyssa Milano contraversy from 4 years ago. Her mom went on a rampage to have her daughter's illegally used pics removed from the net. A bunch of rather noteworthy models also joined the crusade, one of them being miss Alley Baggett. I remember hearing about quite a few webmasters being sued back then, and rightfully so.

These days APIC is there also as a service to content producers, who can buy a membership there in order to have their content policed and protected, so in that regard APIC is a very valuable service. But there are cases like this one where the webmaster is NOT at fault and has been falsely accused (by some unseen party apparently, APIC probably doesn't act alone in these matters), so the point people are trying to make about giving the webmaster the benefit of the doubt and allowing them to either remove the content or show proof of permission-of-use or ownership is a valid one.

I don't think its wise to use topbucks anymore if the company removes accounts so quickly.
They should get all their info correct and not delete an account on the spot.
Shame on you topbucks.

That's right, Steve Easton was his name.
I'm not sure of his status as "head of APIC" at the moment either.

I can definitely see something like APIC being a valuable service, and btw thank you for answering my question CDSmith

However if this association originates from Alyssa Milano's mom (yeah I know the whole story lol) then well, it seems likely that these people would hate adult webmasters in general and very possibly are biased when it comes to our part of the net.

Hey, maybe I am wrong and just jumping on APIC and really don't know much about them. But I do know that I have grown up in Hollywood, and when someone like Alyssa Milano and her mom is mentioned it just does not lead me to believe that their intentions are in our favor.

(ok so i have to mention the part about how most people wanted to see alyssa come to the "dark side" anyhow--term quote jenna)

Kyle's mom from Southpark (sheila b--?--sky)

Exactly you contact the webmaster FIRST and remove later. Good job Lensman.

Topbucks is a fucking joke to simply delete an account instantly. I'm actually mad a company I thought was pretty good will act like that.

I think I remember seeing an APIC logo on the Oliver Klozov sites a while back. Maybe Glyn has some good insight about it.

What I do know is that APIC definitely serves a purpose, and that purpose should mainly be about protecting the rights of the owners who own legal copyrights and electronic intellectual property. As far as Alyssa Milano and her mom goes, they were just sick of seeing alyssa's pictures being illegally spread all over the net, and I don't blame them one bit. Why should a hundred thousand so-called webmasters make a fortune from pics that they stole or "doctored up" in some way?? The Milano's aren't against webmasters, she has an income from modelling just like a lot of stars have, so legitimate webmasters are her friends too.

It's about how wrong it is to use pics on your website when you have no legal right to do so. It's about people who fuck over content producers, and it's about doing what's right for a change. And APIC charges for their services because donations just don't cut it.

yeah, but I'm sure as with most "non-profit" organizations, the people in charge at APIC make a nice, FAT paycheck.

Again, its about money.
