    WHO iS AT FAULT HERE? WHO SHOULD MAKE RESTITUTION

    Scenario involves 3 parties

    1. Service Provided
    2. PayPal (for 3rd party processing)
    3. Buyer

    The Service offered. - Logo Design by freelance designers, dependent on money offered is decided by freelance designers if they wish to participate and pretty much how hard they will work.

    Buyer buys a service, The service claims 100% no refund policy, use system at own risk.

    Cost $75 plus $5 service fee +paypal fee's Total: $81.34
    The cost is based on how much the buyer wants to spend on project.

    Ok, the service lasts 10 days, over 21 designer entries have been submitted.
    The buyer did little to communicate with designers, and end result, buyer asks for a refund with reason being "unsatisfied"

    Refund denied, buyer threatens service provider with chargeback.

    Time goes on, 20 days later, paypal complaint is made.
    We responded proving our no refund policy documents etc ec.

    10 days later, the case is now made into a claim by PaiPal. Which gives us the option of 1. refunding the full amount, refund partial, or provide a tracking number. (P.S. A claim can only be made on TANGIBLE ITEMS)

    Service Provider emails Paypal support, asking for assitance because, we can't provide a tracking number, explaining that it is a non tangible item..

    Well time passed and paypal issued a full refund to buyer.

    Paypal hours later, responds to service provider email indicating they did make a mistake and the refund should not have occured... that the service provide should contact buyer and get money paid again (HAHHA FAT CHANCE THERE)


    Who should make restitution, if Paypal can go into my service provider and withdraw money, can't they do the same from buyer? If not, was this not PayPal's fault and they should refund service provider and make claim from buyer?

    Why does PayPal have complete freedom in above scenario to operate
    shady like this (it's obvious this person had a paypal connection to get that
    non tangible item to a CLAIM)

    MORAL OF SCENARIO, FUCK PAYPAL
    FIND A NEW PROCCESSOR, this one thinks they can do as they please

      No you can make a claim on any item, you just have to respond through their claims service in the time they tell you to and they will close it no questions asked. You waited too long to do this and when you don't respond in X days they auto refund. If you're talking about $85 dude WALK AWAY.

        I had the same thing happen with a gallery spot..fucker charged back after his gallery was pinned for almost 3 months.and told paypal his credit card was used illegally.Not even a response from paypal asking for my side of the story..paypal sucks anyways but I should have known better

          Paypal does not care about your side of the story when a chargeback is received. They aren't the ones deciding where the money goes anymore, the bank forces them to refund and they in turn take it from you.

              No, that is not true, there is a difference between a complaint and a claim, complaints can be esculated to a claim if their are tangbile items.. In this case paypal clearly identified they made the mistake. but still ends up winning

              Well they actually lost, because I just pulled 50k out of their money market and closed down over 500 service sites that I use paypal with.

              And closed my premier account... so they're little fucktard ethics just cost them big, and since once of my services offers services to 1000's of others who use paypal.. it takes that away too....

                Paypal can do whatever they want, their TOS pretty well says they are GOD.

                I had a customer make a claim, non-delivery of goods, they wanted a full refund. I provided them with FedEx tracking and a copy of their signature where FedEx made them sign verifying delivery. Paypal still gave them the refund. A couple of months later, I was discussing the situation with a large group of people that sold the same goods as I did. Ends up that individual has scammed 4 of us through paypal exactly the same way. Appears she found out how easy it was to get what she wanted for "free" and she just kept on doing it.
