You'll have a clause like this...

Artist agrees that Artist may be photographed....fully nude and engaging ...pictorial depiction involving Artist may be simulated or actual, at Artist?s sole discretion....

our clause is quite a bit more involved than the above - just posted a snippit to give people a sense of how it gets you out of prositution -

the girl is being paid for modeling .... and she isn't being paid for the actual act of sex ... anything she chooses to do that way .... is up to her....and isn't required by the producer to fullfill the requirements of the job.... blah blah blah

There was a lawyer giving a talk at the Internet-Expo and he said that California was so popular for porn movies as it was the only state that has ruled that porn movies is not prostitution.

Not that you would necessarily get in trouble in other states, but that California has a written, published opinion on it.
