MIAMI - A Dominican woman is fighting to stay in the United States after her husband died during an interview with immigration officials.

On Aug. 10, Juan and Maritza Hernandez went to the Immigration and Naturalization Service building in Miami, expecting to leave with Maritza's permanent residency.

Instead, 50-year-old Juan Hernandez suffered a fatal heart attack during the interview.

According to Maritza Hernandez's attorney, the immigration official was questioning Juan Hernandez about the date in which he proposed to his wife. He could not remember and then seemed to faint. Doctors said he actually suffered a heart attack and was pronounced dead at a hospital.

My parents are Domincan, I'm am american citizen. Kind of stand in a wierd place, if this was a true marriage then yes she should stay. If this was one of those marriage scams for her to stay give her the boot. There in lyes the problem

Exactly. I think that they should come up with a new type of green card. One that says that they will NEVER be a citizen, but still have to pay SS and taxes etc. For situations like this. A non expiring one.

The solution that I have been able to cnger in my own mind is broken dwn in 2parts, and I am latin, but I'm being very bias here!!

1:The problem with not paying taxes whitch is one of the biggest concerns with the American pulblic.

problem:If you are a iellgal immagrant, and you are current working in this country and you are paying taxes the money obviously is going back to their original countries.

Solution: When anyone goes to a western union or financial institution to send money the should be asked for citizenship, if know can be provided automatic 50% tax on the money bieng handled. Money would be taxed to the financial intituation.

If money is physicllay bieng taken over borders, they are caught 75% tax on the amount found taxed by the federal intitution that catches them.

2: Most Americans have a problem with illegals using up federal funding (medicare, social security, welfare etc.....) Here is what I propose.

A: Cut it all out for every one that can't prove citzen or legal residency in this country. Now like the majority of the population in the U.S. We as a people don't have a problem helping someone out if there is something to show for it. So with all these women that are having kids left and right when it comes time to collect these resources.

1 if they are working they need to show payment of taxes.

2 If they are not working then they need provide their kids reports cards if the kids aren't mainting at least a B average. They recieve NOTHING as the parents of these people are aloowing a generation of dumb asses, and if your like me I say FUCK THAT!!

Though these two problem solvers could be tweaked a bit in theory I believe they can work. It accomplishes a few thing

1st it shows that the U.S. will not tolerate someone not trying to pay up when the rest of the population is FORCED to.

2 It show's we will help you if you help your self, and your children! If you don't you don't get shit and you can go

When I had my immigration interview to stay in the UK after I got married they asked my husband to prove he was in love with me. We were very obviously in love but what a dumb question because how to you prove that infront of an offical that has never met you before. Obviously they believed we loved each other but it was a really stressfull interview because our whole lives depended on that moment. I can see heart attacks happening in that environment for both those that are legit and those that aren't.

Of course she should be allowed to stay, she was married (I'm assuming to a US citizen) and she was doing the process the legal, correct way.

Ouch thats a long time.

I have a friend in miami, who they have been trying to deport for 8 years. But his country has TPS ( temporary protection status) in the mean time, he is married to a US citizen, has a sin who was born in the US, owns a construction company that employes more than 20 fulltime people, and pays more that 50k taxes a quarter.

So as long as they are raising smart kids it's ok to give them financial aid? What about taking away financial aid from american families who are also raising "dumb ass" kids?
