Blah its official...I'm being sued

Well...Some of you followed my previous thread about being C&D'ed over the domain...Well they finally got me at the address listed under the domain...

Seems I am now being sued...oh the joys...

It even includes a part about me to be believed to be operating porn sites...which could tarnish their name...

Attached is the gist of the paperwork

Good luck on them getting any $ out of me...haha

Waiting for my attorney to call me back now...

I told you the sheriff doesnt deliver C&D's, he delivers subpoenas.

You might also want to consider that they have 20 years to collect on any judgement they get against you. If they can show that your actions were intentional, which you pretty much admitted to in that other thread, then bankruptcy wouldn't get rid of that judgement.

My advice, eat some humble pie and settle this FAST. Step 1, immediately offer them the domain.

The best thing to do is fight it, spend a small fortune in legal fees, beat the rap and then let the domain just sit and make you nothing what so ever while you eat Kraft Dinner to the sound of running water in the back of your toilet.

That'll show those bastards!

My favorite part of the lawsuit is "LakeSuites is further damaged by my actions and its unwanted association with me because, upon information and belief, I create and operate software used in the adult entertainment industry, and or is a webmaster for various internet porn sites"

They also say in the lawsuit that I failed to comply after they sent me a letter advising me of the violation...("Upon receipt of said letter, I failed to comply, continued the operation of the websites.

This is untrue...I never got a letter...They sent a sherriff to the previous wrong address...And even then the letter is dated March 17th that they are saying that I failed to comply with...

What a fucken joke

Wrong.

They have NO obligation to give an infringer ANY opportunity to cure the infringement. Upon discovery, they can walk into the court and file the suit. They dont have to file a UDRP, they don't have to send a C & D, they don't have to do dick.

These laws are slanted HEAVILY in favor of the rights holder, as it should be.

Offshore corporation will still not exempt you from losing a domain in an UDRP since ICANN regulates this. You would protect yourself from any damages and cost but you would still lose the domain if they have a solid case.

AW > why not just drop it and make the case go away. No reason to burn money like that.
