MICHIGAN -- Attorney General Mike Cox has filed criminal charges against California-based RR Media and a Florida company, Data Stream Group Inc., for sending e-mails promoting gambling and alcohol to addresses registered under Michigan's Child Protection Registry Act. Cox said the charges are the first of their kind in the country and may subject the e-mailers to a fine of up to $10,000 and other penalties. In addition to the criminal cases, Cox filed civil actions against the two companies in Ingham County Circuit Court. These companion cases to the criminal actions seek injunctions against further violations and other statutory penalties.
Utah has a similar Child Protection Registry law. FSC filed suit in November, 2005, in federal district court in Salt Lake City, challenging the constitutionality and legality of that state?s anti-spam ?child protection registry? law, which went into effect July 15, 2005.
