House Passes H.R. 4472

http://xbiz.com/news_piece.php?id=16158

By Michael Hayes
Tuesday, July 25, 2006

WASHINGTON ? A bill that could dramatically alter the 2257 record-keeping statute has moved one step closer to becoming law as the U.S. House of Representatives passed the Adam Walsh Child Protection and Safety Act of 2006, sending the legislation to President Bush for his signature.

The bill, which the House passed by voice vote, targets pedophiles and child molesters by creating a national sex offender database. However, a relatively small amount of language contained in the bill amends 2257 by bringing secondary producers within the scope of the record-keeping law, Free Speech Coalition attorney Jeffrey Douglas said.

According to Douglas, the bill also mandates record-keeping for depictions of simulated sex act and exhibitions of mere nudity.

Backers of the bill hope to have President Bush sign it July 27, the anniversary of the abduction of Adam Walsh, for whom the bill is named. Walsh, the son of ?America?s Most Wanted? host John Walsh, was abducted from a Hollywood, Fla., Sears department store in 1981 at age six. His severed head was later found; however, the rest of his remains are still missing. His killer is still at large.

Although Douglas stressed that the bill would not become law until the president signed it, Bush has vetoed only one bill ? a measure denying federal funds for stem cell research ? since taking office in 2000.

News of the House vote prompted praise from Attorney General Alberto Gonzales.

"America's children will be better protected from every parent's worst nightmare ? sexual predators ? thanks to passage of the Adam Walsh Child Protection and Safety Act of 2006,? Gonzales said. ?I applaud both the House and Senate ? and in particular the leadership of Chairman Specter in the Senate and Chairman Sensenbrenner in the House ? for passing this comprehensive bill, which includes provisions proposed by the Department of Justice. The protection of our nation's children has been, and will continue to be, one of the Department's highest priorities, and we believe this bill will help us do our job even better."

"Protecting America's Children" is one of the most overinflated and mis used phrases in the entire universe. I'm curious as to all of the evil that has come from that phrase.

There is so many fucked up things added on to these bills that Founding Fathers just did a syncronized full and complete turn in their coffins.

WoW

This is certainly not a good thing for our industry.

Looks like a lot of US webmasters are going to be very busy here shortly trying to get in compliance.

lol, I have a feeling that we will need to keep the 2257 papers on text TGPs too, since they are advertising sex and nudity.

For more detail, check out the analysis of Title V of the Act prepared by attorney Reed Lee, and published on the FSC's website - which is posted here.

I don't believe the language of the Act has changed since Mr. Lee prepared his analysis, and it covers all the revisions to 18 USC 2257 in a clear and concise fashion.

The revisions to 2257 are not the only cause for concern within the Act, though... this new legislation is something everyone in the industry should discuss with an attorney who has relevant expertise and experience.

Well, like you said earlier, it doesn't pertain to you so keep your miguided feelings to yourself. Spreading false information only confuses people and further complicates matters that are already complicated.

if you live in the u.s. and built your biz here and off of primarily u.s. traffic - then why would you want to leave? that is a reflexive attitude that is hard to grasp for me.

Okaayyy ... So we now propose a national sex offender database - wonderful. How many more databases exist already?

This sensational news means there will be more action on child abuse issues in reality??

It means law enforcement will be funded to investigate alleged offenses more often??

It means the DOJ will willingly pass over US citizens for trial in other nations for child abuse offenses???

It means the US will not be the only country on the planet who never gave US children rights under the Convention on the Rights of the Child??

I can't wait to see the impact of how "America's children will be better protected" (quote from Gonzales talking shit)

Okaayyy ... on the adult biz. This has nothing to do with the adult biz - other than US law may claims it does. Pedos, child abuse, underage kids or sex offenders were never part of any adult business I've known.

Equally, there is no way on earth, or remotest prospect of ever operating any adult business within the US. There could not be a worse operating environment out of all western countries and the majorty of other nations.

Meantime, since we never did come under US law, it's time to reconsider using *any* dialog on websites which shows any compliance with US law. It's like websites in other nations complying with South African law? Duh? There were positive aspects to some elements of US law which could be used as a "standard" - but the current bullshit has screwed that to hell and back - so why bother?

There is a choice in life - one is electing a favorable business environment in which to operate. Can the last person who leaves remember to switch out the light?

Umm has anyone here read H.R. 4472?

I couldn't find anything in there that had anything whatsoever to do with our industry, it looked like a sex offender registration act to me...
