    'On December 15, 1791, the new United States of America adopted the <a href=http://memory.loc.gov/const/bor.html>Bill of Rights,</a> the first ten amendments to the <a href=http://memory.loc.gov/const/const.html>U.S. Constitution,</a> confirming the fundamental rights of its citizens. The First Amendment guarantees freedom of religion, speech, and the press, and the rights of peaceful assembly and petition. Other amendments guarantee the rights of the people to form a "well-regulated militia," to keep and bear arms, the rights to private property, fair treatment for accused criminals, protection from unreasonable search and seizure, freedom from self-incrimination, a speedy and impartial jury trial, and representation by counsel.'

      Separating a "well regulated Militia" from the right of the people to keep and bear arms. An excellent intepretation of the 2nd Admendment.

          Yes interpretation. The link that you put up has "well regulated militia" in quotes and separate from to keep and bear arms which is without quotes.

              The current adminstration has taken the right to labe American citizens as "enemy combatants" and put them in jail without much "protection from unreasonable search and seizure, freedom from self-incrimination, a speedy and impartial jury trial, and representation by counsel," and few people seem to care - even those who proclaim themselves "strict constitutionalists." Sad commentary on today's society, methinks ...

                  Maybe you are right and I don't know much about the Constitution, but I do know something about the Bill of Rights which is separate from the Constitution. As for the Constitution the most learned Constitutional scholars do not agree and the same applies to the Bill of Rights, so as far as I am concerned I know as much about both the Constitution and the Bill of Rights as even the most learned of scholars, seeing that they can't agree among themselves.

                            If I wake up in the morning and decide to shoot and kill the first person I see, I will have all of the protection given to me as a US citizen.

                            However-

                            If a US citizen ends up in a war zone in another country shooting at our armed forces.... He has no rights under the US laws. The US citizen was not in the US, and is not subject to US law. Even the US Armed Forces are not subject to US laws when working outside of the US; Instead it relies on the UCMJ.

                            This is exactly why these fuckers have been taken to Cuba and not to US soil; This way US laws do not apply.

                              The attorneys are now taking the position that Gitmo is in fact US soil, but I do not think they will get very far with that position, because no matter how you slice the pie it still actually belongs to Cuba.

                                Actually the one, or maybe two US citizens, he is probably referring to, are still being detained in military confinement here in the Continintal US ,as far as my knowledge of the matter extends, and there are good arguments as to why they should not be, but thus far the Attorney General, and a court of law is still unpersuaded, but I suspect that may eventually be changed by a court.
