We had this discussion before!
All models are 18 or over 18 years old,

Clubseventeen is just a brand name, founded before we were babies!

And that's not the main issue here

it doesn't even look like they copied your site. it does have some similarities, but it doesn't look like a copy of your site.

I don't really think they're copying you or the brand personally. The similarities between the actual products are few and I don't think you have much to stand on concerning the name either IMO.

do you have a trademark or something on club seventeen? if you do you might have a case since they have 'dutch teenclub seventeen'.

ok theyre 'dutch teenclub 17' youre 'club17'. both of you guys do the fake 'hollands got the CrAzEE porn!@#' routine. so because theyre hawking pretend 17 year olds from holland they're ripping you off? i don't get it. using this sort of criteria you could blame pretty much everyone for ripping each other off. what is it you think they stole?

I agree that they're copying you, but what can you do? They're not using your trademark exactly and the design is a bit different, even if it uses your style. I'm not sure about the laws where you are, but it would be near impossible to take them down I think.

Erm, I didnt see 1 damned similiarity between the 2?

I dont really like the young looking girls on EITHER site, and the names are pretty damned stupid... seriously.

The only thing that I saw was that the first site had a pretty damned good designer, it was an interesting tour for sure.

well than theHun should be the only active tgp or McDonalds the only fast food place. You can put a copyright on the design , but their is different from yours as well as domain name doesnt have the same meaning...
I dont know how are they trying to steal anything from you, If your company is running for 28 years they shouldn't even counted as competitors. Just my

How did you come up with those two banners almost being the same?

I guess they're both vertical...

I would say without a doubt their banner design has been influenced by yours. The design is strikingly similar, so I do believe it is aimed at taking off yours. The header text is mildly suspicious;

<blockquote>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&n bsp;&nbsp;&nbsp;&nbsp;Dutch&nbsp;&nbsp;&nbsp;&nbsp ;&nbsp;&nbsp;TeenClub
Seventeens</blockquote>
I reckon having "...Club" and "Seventeens" in that kind of placement is indicative of a rip off, as well as the title, <i>Dutch Teen<b>club Seventeen</b>s</i>. Last but not least, the general theme - soft tones & girly graphics.

I'm not convinced the similarities are strong enough to hold up legally however. Alternately perhaps you could come up with a cunning plan?

If I was you I too would be pissed.

The million dollar question is, do you believe they're cutting into your bottom line? Also, do you forecast this to happen in the near future (how long have they been operating?)? If neither, and you can't take the legal route, I don't believe you should do a thing.

Raymo,

You're absolutely right!
It 's just to prevent misunderstandings in the future!

They will not be competitors, as the membersection of clubseventeen.com is by far much and much better than theirs,
not only better but also contains far more content which makes longer memberships,

Only they will receive some sales, because surfers think it's us,
that's what I don't like.......

.....Or are you?

If you think they're taking some sales off your brand name, you should definitely do something.

I am now sorta thinking you <i>do</i> have a leg to stand on legally. I advise you to contact a solicitor that specialises in copyright infringements, and better yet, one that also knows their shit in the online adult biz and/or internet law.

I think if you think 17 and Seventeen can be copycat, rather then just a common number or spelling of a number is a brand, then you'd assumably think anything with teen in it copied the original teen adult site. I don't think it's a brand issue, at least I don't think it would be worth somehow taking them to court..

Cheers,
Matt

I wouldn't suggest taking one person's comment that is to your liking, and think that is the best option - there are at least 4 or 5 people here that don't think you have a case. Just a thought..

Wow, that site and the banner don't even look remotely close.
I do have to agree that the word Seventeen is used and that is a well known name of course, but that's it.

No probs <b>nickbauuw</b>.

And to the non believers - No one thing can hold legal water on it's own, but collectively, don't you think there may be a case? There are too many similarities to be coincidental. Couple that fact with the header and title and there's a chance.

If nothing else, it's worth investigating. Nobody's saying he should go out guns blazing. :o)

I don't believe anyone on any board takes advice solely because it is to their liking. Discussion boards are for the sharing of ideas and opinions - as nickbauuw takes into consideration what I have to say, he is also considering your point of view. It's a totally level playing field, regardless of which side of the fence you're on.

This argument is flawed. Nobody's saying they're a copycat simply because they have 17 / Seventeen in their site. It's a combination of several elements, not one.

<b>Naughty</b>, how could you say the banner 'don't even look remotely close'? The models are posing near identical! Not to mention the captions at the bottom: holland for one, and dutch for the other...and..'that's it'? There's a combo of seventeen & club in the name. That is NOT a coincidence, all things considered.

<b>Come on</b>, you can't say that banner hasn't been influenced by the other.

the whole idea and market approach is the same,
you guys can't deny that!

teens from holland
17/ Seventeen
Club
seventeens

It's clear that they are wannabes,
maybe the site is different,
about the banner, it's the style ( same sort of models / pic ) text
etc etc,

about the opinions,
hmmm.....
I think raymo has a real good point of view!

Nysus, what your site's url? or brand name?
If we make a wannabe of your brand name/ market approach, would you be happy mate? guess not~~~!!!

I am concerned of course!

because:
- The surfer will not get what he's looking for ( thereal Seventeen)
- Webmasters might think that 17s.com , is club17
( of course newbies, Most of the webmasters are familiar with our product already ) and start promoting the wrong site!

It can't be denied that this is something to corcern about!
Thinking about our sales and reputation....
true? or false?

I'm sorry but I see no trademark or copyright theft.
If you take legal action I would bet 17s.com wins.
You cannot claim to own an entire niche. They design is different from yours as well.

lol,

They are doing a site with the same theme as you guys, it sucks, but its not illegal...

If you want to know something more interesting about the people behind 17s.com , They run livesexlist.com which steal video feeds from a lot of people.

Now thats low..... and most likely illegal

just so you know, i think your banner is a bit broken. its returning a content-type of text/html (IE might ignore that, but it shouldn't). so as it is now it's coming up garbage text.

Im pretty sure you cant trademark "17" or even the word "Seventeen". If you could, every time anyone did math they would have to pay you a royalty...

And as said above, its sucks that someone moves into your market, but there is no law against... If it was a blatant copy yes, but I dont see alot of similarites, other than the Fake 17 thing...

Not convinced? Check out the banners. *blink* *blink* am I seeing double? *g* It is symmetrically identical in terms of placement of elements - logos and captions - but most of all ... that freakin pose! Even the grrrl's top is pulled up the same way ... <i>!</i>

<i>Dutch TeenClub Seventeens</i> aren't only doing the same niche. That's not the issue. The issue is they're doing the same niche <i>along with</i> a strikingly similar branding & banner design (with same caption at bottom, <i>in effect</i>).

In essence; No, I agree, you cannot copyright Seventeen/17, and it does not mean everyone else using it is copying. No, promoting dutch porn as well as a competitor does not mean you're copying. No, using a near same banner as a competitor does not mean you're copying. No, using <i>Club</i> in your name does not mean you're copying. And finally, using a similar marketing approach to a competitor does not mean you're copying. <i>However</i>, employing all of the above certainly <i>does</i>.

I believe <i>Dutch TeenClub Seventeens</i> are trying to capitalise on <i>Club Seventeen</i>'s name. In my book that is just not right.<br></div>

What's so unique about those banners?
I, as well as many others have been making banners like that for the past five years.. there's nothing new or unique about either of them...
