They could try to argue entrapment, but from what I understand they handed over plenty of video and photo footage including audio of targets they wanted to hit.

Eric Harris and Dylan Kliebold built and detonated a number of pipe bombs. They talked for several years about blowing up buildings. Go to Google and do a search for bomb -iraq and you'll find a number of recent cases where people are being charged/sentenced for bomb threats, planting bombs or having the material, including an 11 year old girl in PA.
