I actually read this whole thread and still have no idea why anybody is talking about getting a new tax ID for a freaking contest. Sounds like some red tape some pencil pusher would setup to avoid and prolong any actual action.

Sly - I'm so glad I'm not the only one thinking the same thing.

I even followed that link to figure out what was so pressing about this ID. They even ask you to justify why you are asking for an EIN - this leads me to believe that it's NOT obligatory (and can use your SS#) and that another company can't FORCE you to get one if you have your SS# & no employees. Then again I'm Canadian so maybe I missed the IRS Business 101 course.

There is absolutely no reason each party can't use their current business for the contest. Furthermore, it isn't your business what the other person does or doesn't do with their business, mind your own. Do you march into the farmers market every Saturday morning demanding to see business licenses?

Do you have any idea how stupid you're making yourself look? Maybe you don't care, I hope thats the case. You are telling people who have made millions and millions of dollars how to setup a business. Do you realize that?

I wouldn't doubt it at all. I guess I'm just from the "old school" of business. One thing I will say about it is that although many of the practices in this industry would be view as rediculous by mainstream big business, some are indeed quite clever.

From what I can gather (and I could be completely wrong), I think it is somewhat based on a series of miscommunications. It appears that Ryan (stickyfingerzdotnet) wanted to challenge Serge (Winetalk) to some kind of contest to see who could start a brand new Online Adult Company (with a start-up capital limit of $2,000) going "by the book" (in regards to the formation of said companies; hence licenses and permits) and see who could grow their company bigger faster. Serge (or Forest?) then decided to up the ante by saying that the challenge would only be accepted if there was a $10M wager ($5M placed in an escrow account by each of the 2 parties in the contest) on top of it.

Fast Forward to now: Serge thinks that Ryan only has $2k and wants to bet the $2k (instead of $10M) on the outcome of this contest; when in reality, Ryan is only stating that the start-up capital for each company be limited to a max. of $2k (with no money being bet).

That's what I have gathered from this thread thus far; however, as I stated before, I could be incorrect).

Which is what I thought from the beginning - the company paying you is doing their due deligence by asking the number (SS# or TaxID/EIN) once you give that info and they send their paperwork - they've done their job.

Refusing to give either/or, (and having a US address) then I'd say the company is right in refusing to do business with you.

Well.......... yes and no. No, no one can FORCE you to get an EIN, however many major corporations, wholesalers, OEM/ODM, etc., will refuse to do business with you if you don't have one and are using your SSN. Also, in many instances, by using your EIN on purchase orders (for resale) it is considered B2B and the B2B tax liabilty transfers to you (meaning you don't pay taxes and the other company does not charge you sales tax on most things). However, you being a Canadian citizen makes it more complicated (international), so if you really have a desire to look into it I would recommend consulting an attorney or accountant that specializes in international tax laws. :)

This is very true, there are also many companies that don't ask for it. Most of the companies that I have run across that ask for it are Tier 1 (and some Tier 2) distributors and wholesalers, as well as quite a few of the bigger Fortune 500s when you start discussing exclusive rights and such. Many of those companies also want to see a D&B Number. I have yet to run across it in this industry though.

(and yeah, I've seen the same bonding issues when applying for certain permits as well :Oh crap . I hate that crap)
