    the US Immigration System is fucked

    My sister studied in New York and then got married to her american boyfriend. Shes been living there 5-6 years and shes just got a $45k / year job but immigration won't accept her on some technicality!

    So she might have to leave her husband, her job and the place shes lived for 5 years and be banned from USA for 7 years.

    At every stage she has had a nightmare dealing with the immigration system why does the USA make it so dificult for people from UK?0 (Despite being related to me!) she is an educated person with a American Husband and a $45k / year job! she is not a burden on the system.

    Land for the free if you have $500k + to setup a bussiness or you are from a poor country and want to work shit jobs americans don't want to do or if you are Irish!

    The UK and USA are supposed to be on good terms we are in the stupid Iraq war and everything. UK does not make it this hard for US citizens to come and work a good job in the UK, why does USA do it to us?

      I am intrigued to know what is this technicality you speak of.

      If it is a technicality in the sense of being caught dealing drugs or what have you then she´s screwed.
      SIG WAS NOT TOO BIG! It had it´s allowed maximum 120x60 size and no more than 3 text lines of DEFAULT SIZE and COLOR, we know. But because we deleted the sig and you forgot on what server your 120x60 image was stored and how it was named, you are now forced to use this text.

              That really stinks. I went thru the whole INS thing when I married someone from Scotland and we had no problems. The whole thing was over & done with in 2 years. What's the technicality?

                Sounds weird, as marriage to a US citizen is usually guaranteed green card unless you fuck up at the interview.
                I've heard of cases like yours but that was because one of the party was caught overstaying their student visa or some other infraction prior to getting married.

                  no nothing like that! I think it is a problem that last year her and her husbands combined income was too low. The reason for this is she was not allowed to work because her application was pending! Her husband broke both his legs in a car accident and was in hospital for 9 months and couldn't work either! but now they are both back to work and shes on $45k / year but because of this have told her to stop working and she will lose her job!

                          Spanno, I assume you make good money and report your income. You sign a paper and sponsor them. That would solve it.

                                    I agree with ya about our immigration policy being shit, but sometimes people need to buck up and take responsibility for their own action

                                    Anyways, it sounds like she is the type of citizen this country wants, yet INS is wasting its time on her instead of tending more pressing issues..

                                      If immigration revokes her work permit, it's all over. She basically has to start over.
                                      If they deport her... she's screwed.

                                      They could both head back to the UK of course. Always an option.

                                        no! she had permission to work while her application was pending she has now been denied yesterday and told not to work so she might lose her job if she can't sort it out.

                                        I don't really want to go into details but something is very fucked up when someone with US education, a decent job and a husband and five years in the country can't get a residency.

                                          It is true that it is harder to go from the UK to the USA than the other way around but let me assure you it isn't at all easy to become a UK citizen when you are an American either. Took me ten years.

                                              she has done wrong. Transferring from nonimmigrant (student) visa to Immigrant is a little bit tricky. There are laws and restrictions. She should have left and got a Fiancee visa and come back and marry. Do not blame the Immigration in U.S.A.
                                              That's why they give instructions. 6-7 years?!?

                                              If she would have done the right way as stated above, she would get greencard in 1 1/2 years and by now she was a U.S. Naturalized citizen.

                                                  That's ashame. Income does play a big part of the whole thing. I remember having to provide the previous 5 yrs' tax records plus proof of annual income with one of the forms I had to fill out. It had a preselected annual income requirement that I had to prove I had met and/or exceeded to show I could support a spouse solely on my own income.

                                                  With her husband having been out of work for 9 months last year, I guess he didn't meet the requirement. She's trying to get approved based on an American spouse so it's up to him, as the American, to prove to INS that he can support her on his income, not that she can support herself. Hopefully they understand the situation he was in with the broken legs and the inability to work because of it and approve it. I wish her a lot of luck.

                                                    Gone through that myself with my wife. Not being rejected, but the whole immigration process. She couldnt work for 3 years while we waited. Hope it works out for her.

                                                              That is suspecious for the USCIS. Sponsor needs to have a job plus he's a guy that's another story..
                                                              Something is fishy so they will deny the case and he will get into trouble plus she will get a Red stamp on her visa and will never be able to come to the U.S. or 10 years ban

                                                                Our experience hasn't been that bad but we did a lot of research and avoided making some mistakes. My wife was already here on an expired student visa but because we did things properly had no issue getting her 10 year green card.

                                                                      She gets rejected because "How do we know you will not remain in the US after your visa term expires?". That was the first dumb-ass excuse.

                                                                      That couple personally own 55% of a chain of .. around 380 international hotels - including a number in the US, - and currently buying majority shareholding in a well-known US hotel chain and completing a deal for the purchase of a cruise line.

                                                                      Like she needs to become a "illegal alien" in a country she has no desire to live in anyways??

                                                                      No biggie in the end - the incident was cleaned up after a phone call to the US embassy.

                                                                        Immigration is fucked in the US. My wife is an immigrant and I can tell you that it is theoretically possible to get US citizenship after 2 years of marriage. Realistically with all the paperwork fuckups and incorrect forms and just general slowness it will be more like 5 years. They cannot deport you though if you are married to a citizen its basically impossible. They have a bunch of BS about getting a greencard, but they don't enforce any of the laws so it doesn't really matter. The only way you are going to get in trouble is if you get busted for drug selling or gangbanging. Its easier & cheaper to deport you than prosecute you. I really think that they should allow anyone with a 4 year degree a greencard. Most illegals are people who over stayed their student visa (except fence jumping mexicans). If they gave everyone with a degree a greencard they would be really motivated to finish college and we would have an influx of educated employees.

                                                                            Permenant residency due to marriage was more of a red tape nightmare than difficult for any other reason. The biggest pain was after a year of marriage (you have to go once you get married and then a year after) that it came down to somebody behind a desk judging if my husband and I were really in love. Hoenstly, that was what they had to judge - somebody who never met us. Luckily we were lovestruck so it was hard for them to say otherwise and then it was just red tape. That was because I came from another Western nation. I was in line at Lunar House with wives from other countries that were sent back that had been married just as long as me, etc.
