Warning biz thread - content producers & site owner 2257 question.

So many 2257 threads, one more. Have a serious question.

The law requires the address of the keeper of records. You own the site or produce the content, that's you. Your home or biz address.

If you lived in Polk County, FL for example, you would not want to list your address. There are several cities through-out the US where you'd want to keep a lower profile, yet still comply to the law.

Any solutions to the dilemma. Is anyone running a 2257 record keeping service in a porn friendly place?

I know move to Canada or California. Can't do that. Setting up an office in south Flordia with staff sounds like a great idea, but expensive for the purpose and out of the question?

yeah i have the same problem. i live on a military base (NO, im not telling) and i know its risky but i use my PO Box addy. But now im thinking about switching to my moms house in Vegas.
But i do believe it states somewhere that its suppose to be a residents or buisness location.

Don't think PO Box covers it, they want an address where they can goa and review the records. Suppose to be open during normal business hours etc.

If you are working out of your home you could be in violation of zoning laws. To legally have a business you need a business license. See the problem?

Technically, you are operating an adult business and that could present other zoning nightmares.

No. You do not need to list your home address. You can use a service, however, you have to have your documents there, and maintain business hours.

Meaning that if they show up on Tuesday between 12-5 (or whatever your hours are) then they can demand access to your 2257 documents, which you, or the person there, must provide.

So.. you can have another service for your home office answering service, mailing, whatever. But you must have posted business hours, and documents must be at that address.

Some clarification needs to be made between the old and currently in use regs and the ones being fought as well.

Hours of course are "reasonable business hours" though if they are to raid you expect it to be on a Friday or a day before a legal holiday at or around 5pm to make it as near impossible for you to reach your legal council for as long as possible. Three day weekends are ideal for a late evening Friday raid.

So true. As always, best consult counsel.

I do not know about others who host places, but I know some of my hosts now require you to have copies of your 2257 scanned, and copies on THEIR servers, but in your folder, and in a subfolder for docs.

Which is actually a pain at first but nice. Then if there is a question, they contact host, host provides, and no need to come after you.

But not all hosts do this. But I personally prefer it that way.

PO boxes, mailboxes etc, fedex stores are all NOT acceptable.

Now, if the "new" 2257 rules are in place, you cannot have anyone else hold records for your company unless they are an employee. Admittedly, that could be a token $1 a year job, I guess... but they would have to keep business hours and be open at least 20 hours a week to allow inspections of the records.

Just listing your Mom's house isn't going to work unless Mom has the records and can actually handle a DoJ visit.

Some people use lawyers (as an example). If the DoJ comes calling, this could get expensive!

Careful how you do it. a PO box certainly ain't gonna cut it.
