depends on the state, the laws in that state and the laws on defending yourself and property.

personally, i think that if someone sticks a gun in someones face, my opinion is that they should be shot and killed. you can't assume he won't kill you when he crossed that line and used a gun, the assumption is that he will use it.

No it is not real. And if it where they guy behind the register is headed to jail for murder.

The first shot at the guy that hit him was enough to stop him. but then the guy walks up, looks at him, and shoots him two more times. Each shot was done with thought, and shows that he knew what he was doing. He knew he was shooting a person that was unable to shoot him. All he had to do was remove the gun, and call the police.

Also by moving the body, he is showing that he had an intention to cover something up.

It's all documented on fairly clear survalence tape. As long as the clerk pleads that he was in fear of immediate loss of life and limb, there isn't a single state that's going to put him behind bars.

First shots were self-defense. Not to sure about the last two, depends on what the guy on the floor was doing, if he was going for his gun, it was self-defense.

And who posted the Felony Murder post is a jackass and had no idea what they are talking about, and didn't watch the video.

Washington State.. if you have a gun and someone reaches into their pocket and pulls out something remotely metallic, you can pretty much feel free to shoot em. As long as their is a witness or camera showing what happened.

If thats real that clerk is gonna spend some serious time, the first shot was enough to allow the clerk to get away from the danger. Then the clerk also drags the body away from that area, whats that about?

It definitely starts out as self-defense.

When the guy is laying behind the clothing rack the camera can't see what is going on. So if the clerk says the guy was threatening to shoot him, still had his gun in his hand etc then the killing shots would be self defense.

If somehow it can be proved the gun was out of the robber's hand when the clerk fired the last two shots, that would be different - since the guy would be unarmed at that point - and could lead to trouble.

In either event moving the body afterward is going to seem suspicious to the police.

Actually when the guy walks to the right of the rounder, you can see the guy on the floor reach for his pistol again and start to point it towards the clerk. That makes it ok to just shoot em in the head

i dont think that the additional shots matter or play a role at all. you don't shoot to wound...ever! either you shoot, or you don't shoot. even when someone is down and still holding a gun... they are still a threat. it doesn't matter what anyones "feel good" opinion is. the fact is that he is wounded, has fired shots at the clerk and is still holding a gun. for all any of you know, he may have been told to toss the gun and just screamed "mother fucker, i am going to kill you"

also... it looks staged. a tubby white guy with no mask and nice/clean clothes... robbing a shitty clothing store and the clerk happens to have a pistol handy. seems suspect to me.

The real question is - what would YOU do if you got shot at, then defended yourself and got the "guy" down. Would you keep on shooting to make sure the other "guy" was dead?

The other question is - why are there so many guns in the US?

The third is - why do you work as a clerk in a store?

Anyone who's ever worked as a nightclub bouncer will tell you - even when the guy is down...don't stop kickin' him in the guts until you're absolutely convinced he doesn't want to get back up and fight some more.

The courts wrongly assume that everyone is able to react with a perfectly clear mind and logical thought process when confronted by someone willing to use deadly force on you. In reality, that's not the case. Its not like Hollywood where the scenario is all scripted and everyone knows what they're doing. Decisions are made in split seconds usually as a result of a fight-or-flight panic mentality - often without the benefit of all the minutia information that might be supplied to a jury afterward.

To me, if someone's willing to commit deadly force against you in the commission of (let's say)...an armed robbery - you have every right and justification to take that person's life in defense of your own (or your family).

(the footage in the link is fake, btw - I saw an unedited version on another site awhile back...it was all staged).

Ya I thought that too, but if you watch the video again, you will see that the guy, while on the ground reached for his gun, picked it up, and pointed it at the clerk, that is when the clerk fired, making it very necessary.

I have no idea why he dragged the body, but I have never shot and killed someone as they robbed me, so not sure what goes on in your mind at that point.

Getting a permit for a gun in a store is usually not needed, it's carry permits that you need for outside your home, Or business! The whole thing is stupid, 2 shots max, don't shoot the guy while he's bleeding on the floor! Aim for the eyeball, softest place to get to the brain, or just carry a big gun!!

Which reminds me, I need to get a hold of Donny to go shooting!
