Stand up guys. Right. Who don't respond to ANY complaints. Who don't grab ANY of the reins on their stupid spamming affiliates. Who ignore REPEATED, LONG-STANDING requests to shut down their stupid fucking spammers.

One day, someone in this industry is going to go to jail for this crap. Porn industry is bad enough in my books but the fact that NONE OF YOU CARE that this is just a bad way of doing business makes no sense at all to me.

I sent every single complaint this year to all of the addresses except for sales@.

You should already have that email now, including the complete headers and the contents of the message, plus a breakdown of each of the URLs to make it easier to tell who is spamming using my email address.

I sent today's complaint at approx. noon today eastern time. Your response to me, here, in this forum, is the first I have ever heard from ANYONE at your company.

I have also complained to you in similar detail on Sept. 14th, July 17th, May 10th, March 16th and March 4th of this year, all for similar spams, all with no response from anyone. I had also complained at least 12 more times in 2005 for the same spamming. I logged every single complaint with you, and sent a copy to the FTC and several other authorities. Nothing has changed.

I see even exposing the rampant spamming here will do nothing so I'm going to work directly with law enforcement until this fuckhead spammer is caught and then sue him for abuse of personal data.

You and your goddamn spammers should be ashamed. If getting law enforcement involved is the only way to get your attention and actually do something about this is the only way then so be it.

I emailed you AGAIN with the exact same data I sent before. I received no response. Meantime this spammer is getting paid by you and you continue to profit from him at the expense of my reputation and personal information being abused. This is completely unacceptable in any industry, but I certainly hope it puts a huge black spot on the porn affiliate industry. If you can't police yourselves then you get exactly what you deserve. I am copying every single posting from this thread and including it in my evidence to the FTC and the New York Attorney General. Trust me when I tell you: they make a difference. Together they have been responsible for shutting down numerous companies just like yours when they fail to stop spamming. You can insult me all you like. I am not stopping this complaint. Two full years of spam from your company - evidenced by NUMEROUS OTHERS on this fucking thread - should be plenty of evidence against you. But when you couple it with the numerous examples of spam, including the tracking down of all the affiliate ID's and other evidence associated with the spam runs, as well as all the faked headers and failure to comply with everything CAN-SPAM is there to protect people like me against: your company is going down. All of you others: you may not be spammers but you should never refer to anyone who simply dismisses these complaints as "a stand up guy." A stand up guy is someone who cares that a 10 year old could possibly get this crap. I never used that email address for anything. I never posted it publicly. I certainly never gave anyone permission to send me adult-related sites. Yet here is Traffic Gigolos, regularly abusing that address. They know nothing about me. Which should have been enough info for anyone to track down the idiot who spammed me. Instead you claim that you "don't accept mail traffic." Well if that's the case WHY AREN'T YOU INVESTIGATING THIS INCIDENT?!?!

Not one line of this message, and not one other part of it, is CAN-SPAM compliant. In fact beyond that: it violates several federal obscenity laws. Apparently Traffic Giglos does not care about this, as evidenced by Mr. vvg's fabulous rebuttal.

Let's imagine you're a parent, and that your five year old just received this message. Your five year old's address has possibly just been created. You haven't even done anything with it yet. This is the first message that this five year old receives. I have evidence - strong evidence - that this kind of misuse of email addresses is taking place on behalf of Traffic Gigolos. And here they are trying to brush me off.

Saying that Traffic Giglos are stand up guys is like saying the taliban is a nice bunch to invite to dinner.

I request that someone from Traffic Gigolos contact me at the email address I have repeatedly emailed you from with this precise complaint. And if I hear one more brush off from this group, believe me you will be extremely sorry that you did so. How there can be any legitimacy in this business when you all gang up to cover each others' tracks like this is beyond me. This is a public record. Legally: it can be used against you. You should watch what happens when that takes place because it's pretty impressive.

I would also like to add: Justin Embry (one of the so-called "stand up guys" you refer to) responded to one of my complaints by insulting me for doing so, calling me an "ignorant little bitch" and that he would "see you in hell" (Yes I kept a copy of that as well, the FTC has it also.)

That doesn't strike me as being very stand up of anyone, certainly not someone who cares about stopping their stupid illegal spammers.

So I finally (just now, in fact) got a response from Brian, claiming he was too busy or out of town on the weekend and could only get to this now. I could understand that except that he took the time to post here first and essentially call me a liar.

While I appreciate the response, that will not, in all likelihood stop the spamming from continuing on. I'll stop posting here for now but believe me the second I see another goddamn message promoting yet another Traffic Gigolos site: you will hear about it. You affiliate managers don't know your legal grounds
 

After some back and forth with Brian from Traffic Gigolos, I think it is crucial to underscore a key legal point which I think several of you may have missed in the past year or so. I'm posting this here as a service so that porn affiliate managers can be more aware of the legal facts regarding spamming affiliates.

In the most black and white terms: your spammers are equal to you in the eyes of the court.

If you have an affiliate program, and you allow anyone to sign up, and some of those affiliates spam: your company is responsible and can be prosecuted.

The FTC among other authorities has very successfully prosecuted several affiliate programs in the US. Not just porn affiliate programs either. As recently as a few weeks ago a rogue refinancing spammer caused a major bank to be investigated for allowing spamming to lead to profit on their end. If your company is represented by a spamming affiliate, even if you do not know who they are: you are the one who goes to court. I am not making this up. It is the law.

DEFINITELY thought you people should be aware of this because it certainly appears that Brian among others was not.

I should clarify also: I don't care that porn is your business. It offends me personally as a subject but I don't care that that's how you make your money. What I do care about is that I continue to see porn spam from any affiliate program. Any program that loose deserves to be sued! The law has been extremely clear about this point and the lawsuits have been (at least I thought) very high profile once they were successfully able to show that the company was the one on the hook despite not having directly spammed themselves.

Don't rely on the defence that you, the actual company, are not the one spamming. If your affiliates spam: to the court, that equals you, and you will be prosecuted as such.

Thanx to Brian for bringing to light this misconception. If you do not know this about CAN-SPAM specifically, you are doomed to be sued by someone, successfully. Trust me when I say that that is not the method by which you want to learn the law.
