Sex Ed
With all of the recent court decisions, I though I would discuss a topic that I think very few people really understand. That is - why is porn protected by the first amendment? After all, how many of you can explain how freedom of speech actually applies to porn?
In fact, I doubt that most lawyers could give a good answer to that one, and almost none of the current judges seem to have a clue. The truth is that there is a very good answer to this question - porn educates people about sex. I'm sure everyone is thinking I'm crazy right about now, after all, isn't porn all about shaking hands with the unemployed (in case you missed the early thread "synonyms for masterbation") But think about this: how do you know what turns you on? Someone can tell you that having sex this way or that way is great, but seeing it is a way of learning for yourself if it is erotic and stimulating for you. We all have different tastes, and being able to see what other people do for sexual pleasure is mind opening for many viewers. There are other reasons, too. Porn can act to facilitate discussion between partners. For example, a man might be embarassed to ask his girlfriend for anal sex. He might have even learned about anal sex from watching porn. By watching a movie together, he could ask "does this look like something you might enjoy?" Clearly that is speech, and it should be protected as such. Learning about sex by talkiing about it is impossible. The only way really to learn about it and how to do it right is to watch it. Even if it is appealing to your purient interest at the time, IT IS STILL EDUCATIONAL. While you watch, you are learning what you like and what you don't like. If that isn't an education, what is? That is speech and it needs to be protected. By watching sex acts, you are always learning different techniques that can result in a lifetime of added satisfaction. I know from my personal experience that I am much better at it after having been in the business and seeing all the stuff out there than I could ever have been before. I also learned that I'm turned on by tats and piercings. I never would have learned that without seeing it on video. I guess my point here is simply this: there is clinical sex education that teaches people how babies are made, and then there is porn, which teaches people how to enjoy sex. They are both valid forms of education. So the next time someone says that you're a pornographer, you can tell them that you are really a modern day sex ed teacher. How about that? Your web sites really aren't just smut. Even though your sufers have their pants around their ankles, they are learning something. Freedom of speech is a fundamental principle of a free society. Even though are speech is made through pictures and videos of sex acts, it is still valuable and should be protected. That's why porn is protected by the first amendment. |
