You're correct (at least in my previous experiences in dealing with copyright infringement). In the past our attorney advised us not to have any further contact with the individuals we were going after at the time. The lawyer handled it all directly himself (granted, I was able to provide him each time with addy/contact info I obtained myself privately).

Another thing. I don't care who wins what or who sues who.

The thing is that IF those statements are hurting his business, he should be contacting GFY. They are ultimately responsible for those posts. Any case he had would be much stronger against GFY than SOS because they are located in the US, have the content on their servers, and have let that content remain on their servers.

If the issue is really over loss of business and not sig views, he should be going the other route. All SOS would have to say is "I didn't post it", "I couldn't delete it", "Why did you not ask to have it removed a year ago", "Why did you say it didn't hurt business yourself", etc.

However, if it's about board drama and attention, sue the crap out of the kid. Nothing will change but some long threads and whatever business the attention drums up.

Let them know a Client of thiers has comitted a crime against you and that you have Legal Requests for them to provide you with the owner address of any of his sites. SexFeeder for example.

They may ask for a judge supena faxed to them and some other details.

Oh my God. He was told he can't sue. He was responding to that saying, "Yes I can". It's a totally different issue than the start of the thread. It doesn't mean he's GOING to sue, it means he could if he wished.

Here's a statement from me: "I can rob a bank tomorrow."

Will I be robbing a bank tomorrow? Did I just say it was going to happen? Same thing. Read the thread in context and that is easy to see.
