Has anyone seen the recent Dateline I think it was where they were testing and comparing tired drivers and drunk drivers? The drunk drivers did better, haha, pretty interesting.

Why? The dude admited that he done a burn. I doubt they would even send him to jail for that I think they would just give him a ticket.

Something I understand also. I've experienced this from the sober side. Smelling alchohol on someone thats been drinking. But if you've ever smelt the air freshener I have in my car first-hand then you would understand. I've had people tell me as soon as I open my car and they are about 30ft away they can smell the air freshener in my car.

Also, after driving in my car and going into a building, 10 minutes later people ask me what that scent is. I ask them what does it smell like and they say Cherry. I guess the smell sticks to your body for awhile. Here's the brand if you want to check it out. It's called

Cops get suspicious if your car smells like air freshener that much. It often has reason.

well i'm just responding back to your response. That's how I know he couldn't smell any type of alchohol. Even if i didnt have the air freshener I doubt he could have smelled anything, this just made me 100% sure he was bullshitting at that point trying to test how i respond to him.

Tthere are many factors that can make the police officer make a wrong decision when testing for sobriety...that's why i think it's a roll of the dice and very uncertain when having to deal with this sort of thing....that's why if you act respectful too the cops and they aren't asshole hopefully they base their decisions/judgement on your behavior towards them.

That was why I asked the cop what kind of test. I wanted to know if it was the breathalizer or the physical test. If it was the breathalizer I was thinking of saying "No, I wont do the test". The poster I was responding to suggested he not say anything at all when questioned. When you are already under arrest is when you should shut up. Cops engage you in conversation to figure out what's going on and to see if you have an attitude. DickShoke did the right thing by engaging him in a polite and respectful conversation. If he would have refused to speak to the officer the cop would have hauled him in sure as hell.

i think it's the same here...if you refuse you'll get your license revoked for a year.

Actually you should shut up before and after you are arrested. The fifth amendment protects you from self incrimination.

You can't be arrested for refusing to speak unless you refused to give your name and address, I think that is the basic info that you must provide.

If you refuse to take a breathalizer, they take you to the E.R. at your local hospital, and do an involuntary blood test. They will then get your alcohol level, and throw you in jail.

Depending on the state. You can be thrown into jail for refusing to take a test period when asked, and I've heard lose your license. Regardless, best to be polite, do what they ask, and get it over with.

The cops where I live are relentless. I got a ticket for leaving my car running while unattended (I was within 5 feet from it) ..... and this was right after Hurricane Wilma tore through the area and the stop lights were not working, there was minor looting going on, and they are worried about me standing outside of my car?

Anyhow, the judge threw it out of court.

that's a little extreme....maybe those were the few asshole cops.
