If you think your boss will risk hundreds of thousands of dollars on a case he can't win, you are seriously mistaken.

If she's cheking the urls on your shirts during work hours doesn't that count as using the business computers for personal use?

She can be doing it during lunch (which is your own personal time at work that you don't get paid for), and she can claim and seeing porn sites wasn't voluntary, that she was forced into it by not knowing that the colleague's shirt would contain an offensive URL.

Thus the sexual harassment part, she was involuntary harassed. She has a better case than him.

She should get into shit for going to the URL at the office. Dumbass!

Should you get in shit for indecent exposure of genital area if one of your coworkers pulls down your pants at work?

Same thing here, albeit less extreme. She didn't know that was a porn site. Swank does not imply porn.

Big Red Machine 03-15-2006 06:32 PM

Linguist - Funny that you should mention that, my man came to my place of employment today and pulled my pants down, he got me alright and more ;))

I agree, she did not know, but come on...had she not typed in the URL to find out what it was than she wouldn't have been the wiser...It's ridiculous to say the least...she was offended after she went and snooped it in on company time and equipment. I know that most places will allow you to use company property at lunch time but some do not...I'm sure she didn't think that "swank" had any religious meaning lol. Anyway, it's silly to say the least.

At least your workplace won't be that boring at all.. :pimp

lazycash 03-15-2006 07:50 PM

I can see how that might be impropriate for most work conditions, but I would have figured the car wash wouldn't really have cared.

I wonder if it is appropriate for employees to be surfing the net on company time.. If not then he should probably 'complaint' to the boss that she'd using the company computer for personal use and see what the policy says.. :)

That's a moot point at this stage. She knows it's a sex-related shirt now, and if he continues to wear it she could try and pull something.

The law is that an employer must take appropriate action on all sexual harassment claims or they can be held liable. If he is allowed to continue wearing these shirts then his boss not very smart.

cranki 03-16-2006 01:54 AM

Girls approach me wanting to suck my cock when I wear my OC Cash T-Shirt! :thumbsup
