My CC holder is fully aware that he has a no refund policy posted (I personally think that he put it up after I asked for my money back), but that is not the course my CC holder is persuing.

I would think that one cannot be sued for a chargeback, because only a CC provider can chargeback, and only if it complies with law, and they have their own attorneys, to keep them in compliance with law.

The no refund policy is a hurdle that is a difficult one but is not insurmountable.

but you're the one that asks for a chargeback. i find it hard to believe that they would even think about allowing you to dispute the charge based on what you've said here.

you need an actual reason and not 'i didn't read the page to know exactly what i was buying.' whats there to dispute? you bought it and the script works.

he can go after you for the money and also the chargeback fee. you get his product for free and he ends up paying the chargeback fee? makes a lot of sense.

you should take a little responsibility for your own stupidity for not fully reading the page. you're in the adult industry and you should know what kind of an effect chargebacks are having. tons of people do the exact same thing and in the end it just ends up fucking everyone.

I don't get the product for free because there is not a product for me to use. It is worthless to me. It makes doorway pages. I have software that requires less effort than his script does. I don't know if you are an attorney or have discussed this matter with an attorney (I am not an attorney and I have not discussed the matter with an attorney), but I would think that a CC provider and their attorneys, know what the law is when it comes to chargebacks. I would think that if the CC provider exposed me to a lawsuit that would, in turn, expose them to a lawsuit by me.

Please educate me on the technical legalities. I feel the need to know.

And yes; it was a stupid mistake to purchase a script when I was not completely aware of what the scprit actually does. As for the script making pages as advertised, I don't know because once I learned it merely makes doorway pages, I did not use the script. Thus maybe the script works well, maybe not.

it depends on who u get on the line when u call to do the chargeback. some will put anything through and others won't.

dealing with a 3rd party processor like paypal chances are the chargeback will go through.

Pathfinder, you most likely won't get the chargeback/refund you're asking for..even if you didn't go thru Paypal. I think they usually do an investigation of the complaint..but once they are done and know you received the product, it wasn't misrepresented (even though he made it sound like it's the shit when it's not) and the product works, they would deny your refund. A chargeback isn't something they do lightly unless it is for a porn membership ; ) He shouldn't have to pay a chargeback fee and have that on his account because you made a rash decision.

if it went through paypal, chances are paypal will just let it go through and fine the seller. i've never had a chargeback occur when i used paypal but i know billpoint never contacted me when a sale was in dispute.

i really had no say at all. i was out the product and fined $25.

I had heard/read somewhere that when you sign up with paypal to purchase something, the terms or something state that you can't chargeback. Then again, this was from a non reliable source.

I purchased the script on 8 Mar and PayPal's response was received on 14 Mar although I was originally told the investigation would take thirty days.

By the way I read PayPal's response "quality of goods received" as meaning that even if you buy something such as script and the script does not work, they will not return your money.
