Judge says google images in violation of copywrites to Perfect 10

LOS ANGELES - A federal court judge has concluded that an image search service run by Google Inc. infringes on the copyrights of adult entertainment company Perfect 10 Inc. by displaying small versions of its images in search results.

But U.S. District Court Judge Howard Matz said that based on evidence submitted at a preliminary injunction hearing, Google could not be held responsible when viewers click on the images and are directed to third-party sites that contain full-size images stolen from Perfect 10?s Web site.

Heres a great chunk of text that is great for the xpays dmca plans as well.

"The judge found, however, that Google did not violate Perfect 10's copyrights by linking to pages that Perfect 10 claims are using its images without permission."

"The judge ruled that because Google receives advertising money from offering search functions, it is not entitled to the same level of free use of the images as other entities would be."

it wont. when you get the thumbnails from the sponsor you are granted a limited license ( usually) to re-display them, the issue is google is not on that license , nor did they agree to it. If google simply signed up as an affiliate of the sponsors they hotlink i assume it would be ok ( under some licenses , some would require links to the sponsor on the same page as any content )

Its about time someone has the guts to tell Google "No". I am tired of seeing Google get away with everything just because a few communists, you know, the ones who think everything is public property and they can do with it what they like, just because Google is big and has made some good products.
