With all the talk about fusker sites...how are they legal without 2257 compliance?

With all the talk about fusker sites...how are they legal without 2257 compliance? Not one fusker site has one word about 2257...?

Or am I confused about 2257 since they are not creating the content are they required to have it?

Fusker sites don't host any content...hosting content is what requires 2257. If they hosted content, they wouldn't be stealing bandwidth.

If you are American and the content appears on your site then you must have 2257 information. Even if it is hosted somewhere else.

If fusker sites don't care about copyrights why would they give a shit about 2257? Especially if they are not in the US and subject to American law.

It's not just "your" site if other people contribute and serve up content. If I were to frame out a FHG, that doesn't mean it's appearing on my site. It just means there is a section of the browser window that doesn't belong to me no matter what the address bar says. Same deal with hotlinked photos, RSS feeds and whatever else.

This has already been discussed before, and more than one program offers hotlinkable promo materials to American affiliates.


So 2257 isn't what is going to shut down Fusker sites. What would shut them all down overnight is if everyone used .htaccess. The only way to accomplish such a feat is if every sponsor posted a message teaching webmasters how to set the file up.

You are responsible for anything appearing on any page on your site. The law provides for some exceptions (ie, SE's, etc).

I suggest you consult your attorney. If they tell you anything differently, fire them.
