Once you make an agreement, there is no criminal matter anymore. Worst you could do is sue him in civil court. So either this didnt happen, or your attorney was too fuckin stupid to inform you of this, or you think the GFY sheep are stupid enough to believe this (and most of them probably are)

think alot of ppl miss the point ... even if u think the demands made by Jay are too severe, he committed a crime, and regardless of how long you really think a year in prison is, I've had friends goto jail, tough guys that came out good christians b/c otherwise they'd be someones bitch. not to mention, the guy is obviously a loser, 32 at home, and perhaps the last thing he wants is a criminal record in the field that he obviously has experience in.

good for u Jay, no one said out of court settlements had to be fair, but as for wordpress and security issues, that part is all user error as its very easy to lock down things on server if you take the time to plan it out.

Just a guess, but they probably left his phpmyadmin wide open, and thats how the guy got in. Typed in hisdomain.com/phpmyadmin/ and bambo. Am I right Jay? btw it wasnt me lol. I had someone not configure mysql right, and had a hacker find that out on one of my boxes. Luckily I do a data backup every 24 hours, so not much was lost. With my issue though the kid was in the Netherlands, and I couldnt get much done about it even with all his information.

1) xxxjay was hacked... it was a very LOW level hacker who did absolutely nothing to cover his tracks...
2) The hacker in question isn't a hacker.. he is a script kiddie with NO money and no prospects in the adult community. Sooooooo... NO MONEY... We talked at length about turning everything over to the authorities but he has no money... so xxxjay cannot recover anything at all... not even a few hundred.... so xxxjay decided to have the guy work it off... the only outcome that would make xxxjay money. Or atleast offest the damage.
3) Anyone who wants to talk about fake drama or ask for proof can kiss my lilly-white ass. xxxjay's ass too... come on over and kiss it fuckers!

What kind of work? Nothing that requires a high level of trust on xxxjays partners/associates part. He will not have access to anything that will effect you. Is it really extortion or blackmail? Not to dive into semantics, but it seems to me you are basically letting him make restitution, which he would probably have to do if he got convicted. by the set up you have you are:

1. saving the court system time and money
2. saving yourself and this guy some time and attorney fees
3. possibly keeping the FBI out of things (I'm assuming this would be considered interstate crime, but im not an attorney).
4. letting this guy keep a conviction off his record
5. giving yourself a better chance of actually recieving restitution

If you made a deal not to file criminal charges, and the guy doesnt keep his end of the deal, then guess what, its a civil matter at that point. Sure you can sue him, but he cant be prosecuted for what he did.

Glad you caught him Jay and that hopefully you can recover most of the lost data. As for if he can sue the guy or no because of this deal. I'm sure Jay has a good lawyer and the deal was made in a Without prejudice kind of way. So that if the guy does not follow through he can bring a new suit on the same claim. Hope something similar doesn't happen to you again rock on Jay 2006 can only get better:)
