So why can't Rodriguez and Santiago be charged with murder in the first degree? Hynes said today that in order to prove murder in the first degree, you have to prove torture -- and he says that will be easy in this case.

But you also have to prove that the person inflicting the torture enjoyed doing it. Hynes says that is an impossible standard and the law has to be changed.

I don't think anything infuriates and saddens me more than children being abused. The US has a very fucked up justice system.
