Can howard stern be attacked for obscenity?

Just curious if sirrius satellite asks for an ID when you order his service.

If not i'm quite sure the relegious right will soon be launching an attack & well lets hope they do, howards got enough $ to fight back and win a few battles for us.

I think the kicker is that because its a satellite based subscription only service that it does not fall under the jurisdiction of the FCC and is more or less unregulated.

I don't see how satellite radio doesn't fall under the fcc, is it not owned by a company in america?

The irony is a bunch of Christian programming was just brought on board Sirius as well. If the far right doesn't like Stern they should listen to that instead.

i believe the FCC only has control over secondary transmissions via satellite, if the feed was originally broadcasted over the radio than re-broadcasted via satellite the satellite company would have to comply with all of the FCC's rules and regulations i don't see anything about them controlling/regulating satellite transmissions in general...

I know. I was just speaking with logic. It would be nice.

Things will probably get interesting but I don't think Stern is going to ape shit. He mentioned in his Larry King interview something about keeping a good balance. Being vulgar alone isn't entertaining.

The FCC regulates technical aspects of satellite radio broadcasts in the US, under the "Satellite Digital Audio Radio Service" rules, however they do not currently censor content as they do with terrestrial audio radio. The FCC allocated the spectrum and auctioned off two licenses in the late 90s for about $100 million each. For the past year and a half, there have been efforts to add indecency censorship. Both terrestrial broadcasters and right-wing organizations have been petitioning the FCC and lobbying congress. The FCC petitions have been consistently rejected, so it will probably require federal legislation to change the situation. Seems unlikely, as it would be so unpopular, but sometimes they slip some pretty unpopular stuff on the end of an unrelated bill. Viacom would probably pay no end of lobbying cash to torpedo Stern.

FCC rules do not go for satalite radio, they are allowed to say whatever they want on there, Also you need a CC when subscribing.

the answer: HBO and SIRRIUS are private services, you have to purchase them. Wich also means they have a ToS agreement and probably a number of other stuff to read before they make you sign... so they are most likely left un-liable for anything they say or do on HBO or SIRRIUS for that matter.


but most people dont read shit before they sign up...

For now Satellite is safe, it would take years and essentially a change of the 1st ammendment to be able to regulate and censor Satellite.

pr0 said nothing about the FCC in the original post. This would be a potentially criminal issue outside of whatever the FCC regulates. Its very possible that some prosecutor could get trigger happy..

sattelite isnt airwaves.. can only be picked up by a customer or someone that has alot of knowledge to pick up the sattelite and decode the signal

It is radio, and it is over the airwaves, it's just that the transmitter is on a satellite in geostationary orbit rather than on a broadcast tower. It uses digital encoding, and a different frequency spectrum, but it's otherwise pretty similar to taditional radio. XM and Serius even use terrestrial broadcast tower repeaters in dense markets to boost their signal strength.

Actually, I had XM for over a year then after I sold my vehicle, I jumped over to Sirius to try something new. I'll have to say, being a hard rock/metal man, I say that Sirius DEFINATELY has a better lineup.

Sure, I do miss O&A, but I think that Howard will fill the gap. I listened to his show today and it was nice hearing him say what he wants. It's just be nice if they would get Jackie Martling back because he's funny as hell, however, with the bad blood there, that's never gonna happen.
