Casino Legal Question

I was wondering if anyone knows the legal issues of online casinos. Specifically I know online gambling is illegal in the us. But since the actual casinos and money and all of that are actually offshore, is it ok to have a casino branded to your sites name, then you host it on your servers, but all the links and actual gaming transactions are done by the real casino themselves??..
I hope this makes sense?
Any input would be greatly appriciated.

why is the online-casino gambling illegal in US? We have the regular casinos here and they are legal.

I am no authority on this but you would definatley not be able to host it on your servers in the US.

One of the big Australian companies that has set up their casino in Vanuatu refuses to let Australians, New Zealanders (not that you care about them anyway) or Americans play.

My understanding (and I may be totally wrong) is that it is illegal for US citizens to play with an Online Casino no matter where it is and that if the US government could get their hands on them the operators would be facing prosecution even though they are offshore.

Except for just checking that the Australian company still doesnt allow those countries, all my info comes from something I was doing 18 months ago so may not be current.

You can't escape tax debts by moving your business outside the United States. Analogizing from that, I would think the Government's position is that, no matter where the server is, you as a business entity are inside the United States. For example, I wouldn't try putting up a kiddie porn site on a Russian server (not that I'd want to do that) and expect the United States government to say, "Oh, that's okay: he's outside the United States."

If you really want to escape U.S. law, the way to do it is to give up your U.S. citizenship.

I've got to agree with Unseen, I have looked into the issue for awhile myself, but I have been given the same analogy by everyone I have talked to also.

Unfortunately, the only way around it is to physically move to a country where Online Gameing is not illegal.

Unseenworld, thanks for the start. Oh and I am NOT trying to evade the us law, ..on the contrary, thats why I'am trying to find out. I have a place that wants to build my casino and me basically feed it traffic for a %. But I don't know the laws concerning an online casino thts why I'am trying to find out.
Thanks...BTW Unseen, you take some killer pics...

Move to the UK!!!!

The law has changed today and now I could prolly set one up in my garden if I wanted to.....hmmmmm....I have a big shed too.......

Seems we can now have non-membership casinos almost anywhere and limit on jackpots for fruit machines/bingo has been removed. Apparently Internet gaming laws are lifted too (didn't even realise we had any). Vegas in Brighton here we come!
Oh - we can now also drink alcohol and watch strippers as we lose our money too.

Now we just need some brown cafes to open up.....

Casinos are licensed and they don't want to create too much competition or casinos of course would pop up everywhere.

One state in the US did give a license to some company to create an online casino, but only those states' residences are allowed to use it..

Cheers
