First of all, most all lawyers work on retainer, which means you give then enough money up front to cover their costs at least initial;y. In this situation, you shouldn't have shelled out $5000 when the total could be $2500. That was error #1 on your part.

Secondly, I'm hoping the terms weren't described as you say "$2500 if it was easy and $5000 if it was hard". Who's to determine this completely subjective condition? What's easy and/or hard? You're not a lawyer, so you can't really say what's easy or hard from a lawyer's point of view, so that determination defaults to the lawyer, which means you're pretty much paying $5000 no matter what. That condition should have been explicitly spelled out. That was mistake #2.

Thirdly, everything should have been spelled out in writing. If the lawyer stated an exact price, then that should be in writing too. If it were in writing, I doubt the lawyer would try to extract more money from you, which makes me think you don't have a written document stating exact fees. Assuming that's correct, that's mistake #3.

So, if I were you, I would simply tell the lawyer that you have paid everything you both agreed on and more, and that you wish to have a refund of $2500. If he threatens to sue you for the additional $2500, then tell him that since you will be required to hire another lawyer to defend you, you will also be counter-sueing him for your $2500 overpay. I doubt he would pursue it any further if the situation is as you described, but if he does, then you hope for the best. I wouldn't really expect to see your $2500 again without a suit against him.

It is also recommended that absolutely any interaction from this point on be done in writing, so you have a written document. Never admit fault, nor appear overly emotional. If he calls, inform him that all correspondence should be done so in writing from here on out.

You may even want to report his actions to the states BAR, which governs lawyers...if he's seriously doing something devious, then the threat of disbarment may give you leverage. If nothing else, it should be made known how this guy operates...
