Neighbor Noise Complaints.... QUESTION...

I have researched my city ordinances and have found that from the hours of 10pm-7am the noise threshold is 52 db in a residential area..

if the neighbors are complaining still while i am at that sound threshold and the landlord of the building is penalizing me with noise complaint warnings..

dont i have an arguement that i am not "able to enjoy peace" because the walls of the building isnt constructed to allow me to play my music according to the sound levels listed according to the city noise ordinance?

I've tried that approach. Unfortunately what you have to watch out for is the loophole written into most sound level laws stating that if your noise source creates a noticeable disturbance to the peace of others even if under the acceptable db levels.

Operating, playing or permitting the operation or playing of any radio, television, phonograph, drum, musical instrument, sound amplifier or similar device which produces, reproduces or amplifies sound in such a manner as to create noise disturbance across a real property line boundary or within a noise sensitive zone set forth in Table I, "Maximum Sound Pressure Levels," shall constitute a violation of this section. Believe it or not, typically the sound ordinance laws are meant more to keep construction and similar industry's in check when working in or around residentials. At least that was the answer given to me by city hall when I went complaining regarding my situation.
