Could it be construed as copyright violation if one where using verbatim portions or complete copies of someone elses Terms and Conditions? Assuming that all contact and misc. info was switched.

With all the other copyright violations to worry about why on earth would you spend time thinking about this???

If they are stealing site design or content you created that is totally different. Man, I didn't even know anyone really reads the terms & conditions.

I'm no lawyer, but I would hafta guess no... because it's usually standard legal text... unless they've customized it into someting funny or witty or some shit...

ok, I see. If you are talking about finding terms & conditions for yourself I'm sure you can change some of the structure enough that most webmasters would not go after you about this.

For your own protection though it would be safer to make sure the wording is correct legally. I personally wouldn't just copy someone else's terms because I wouldn't know were they got it from.

If the terms and conditions are simply quoting a section, such as "Sec. 1465. - Transportation of obscene matters for sale or distribution" then that would be okay.

Otherwise, you're better to run the terms by a professional to make sure that the legal phraseology is correct.
