$350 for the galleries.

That equals $1,350 using basic math skills.

I've paid you:

$500 at the beginning of the project and you've been paid $582.36 so far in checks since. That leaves $267.64.

How do you come up with being owed $500.00 ?

That particular tour wasn't posted all over GFY. It was posted a few times, long ago. This all started in late jan/early feb 2004.

Being dropped from the 50% wasn't included was it? As for your courts comment, that just shows how clueless you are. Lets say you won, Fletch would owe you whatever you've paid him up to date and a few small fees. You on the other hand would owe him $500 to $20,000 per instance of using his copyrighted materials. He could also sue any affiliates using them.

I generally am staying out of this as it doesnt entirely concern me. I was hired to do a job, i asked about my paramaters and I stayed within those parameters.

Here is what I will say though.

I dont know Fletch. I do know donny.

IN the time I've worked with him he's been pretty much upright on everything he's done and talked about having done. I cannot fathom sitting here and reading the other drama threads on this topic fast enough to keep up though I am desperately trying to.

If donny was as fair and upfront to fletch as he was to me then I dont have a clue where things fell apart. I"m pretty sure he was that upfront and fair.

In designing some things for the blog I presumed that if I ever walked away from the project all my creatives were going to become property of Donnys Money. Why wouldnt it? I cannot fathom why when I was ready to walk away I could take everything I put into the business with me. That's just not how it fucking works. It doesnt work that way in the 'real world' and I cannot imagine why it does in the adult world either.

As for the simple math of it, fletch seems to be grabbing every dime he can. I dont know much about fletch and probably never will but it would be sad if that's the case. especially for such a small sum.

Either way I think his tour was decent. I think the one we've worked on together is also decent. I can see why his stopped converting, it doesnt seem to have been udpated for a long time. The entire point of a dynamic tour is that it changes and remains dynamic, isnt it?

Just my 2 cents.

Fletch has asked that donny remove his creatives and stop using it and I cannot say that donny should or shouldnt do this. But I will say that if that is the choice he makes I will eagerly step up to plate and help him resolve that decision, and quickly replace the creatives. I'll also be glad to fill the hole left by removing these galleries by designing more of my own for our partnership. I was hired to do a job and I'll follow it through as instructed.

Until then its in donny's lap.

OK well all I mean is I have seen the tour before. I must have seen it linked from somewhere. I like the tour I am just in shock at why I guess no one sent traffic and how little revenue it generated.

Nobody sends traffic if there are no new materials for them. Affiliates had an initial list of galleries to use to send traffic to. Once those were exhausted and there were no new galleries for them to promote they simply let it die. Nobody sends traffic to the same galleries over and over again.

All Fletch had to do was pick out new photos once a month and plug them into his existing templates. For this he was given a 50/50 share in the tour.

Did he do that simple task? Nope, not once. He shot his wad with the initial roll out and didn't follow through. I didn't ride his ass about it.

Do you have this original contract that says exactly what the $500 was for and what you would be getting for the 50/50 partnership? If you don't then it's just your word versus his, and to be honest, it's not looking too good for you. And the fact that you are using his banners for your other projects and not sending to the original tour you both agreed upon, shows that you breeched the original contract, if indeed there is a contract.

Fletch does good work and while alot of people don't understand the design business, it takes alot of time and creative ability to keep coming up with something that is unique and fresh. When he originally designed the site for you, it was uniqe and fresh and converted. Don't downplay the fact that he is a good designer, after all, you are still using the banners he designed.

Since Donovan, in his own words, has repeatedly stated that he has not paid for the materials in question, Fletch should just DMCA the materials in question.

I don't think any reputable ISP or uplink will risk getting sued

Any and all banners must be removed. Any and all tours with ripped materials must be removed. Any and all materials not used for its intended purposed must be removed. Quite a large and costly blow

$500 was the cheap way out

FLETCH, if this is just more GFY drama then keep on bickering. If you are serious with this then send out the DMCA to Donovan's ISP and the issue will be resolved w/in 48hrs.
